La investigación se fundamenta en el Derecho Constitucional y el Derecho a la educación, en torno al eje de innovación educativa. El estudio tiene un sustento teórico y de análisis acerca de los principales artículos que amparan la educación, así como el panorama meso desde una perspectiva de América Latina. El objetivo del trabajo fue desarrollar un análisis del Derecho Constitucional y la Innovación Educativa. El método investigativo fue cualitativo-descriptivo, puesto que se analizaron las principales divergencias del problema. Además, está inmerso en un marco crítico-propositivo, puesto que, se estudiaron en una parte el Derecho Constitucional, de manera infra ordinada y la innovación educativa con un enfoque en las Tecnologías de Información y Comunicaciones. Propositivo, porque determinó un programa de innovación para ser considerada como alternativa de proceso. Los resultados indicaron de manera separada la importancia del Derecho Constitucional sobre la innovación educativa y la preponderancia de las TICs.
