Tras el regreso a la democracia en Chile, las políticas de justicia transicional iniciaron con la búsqueda de verdad, luego vinieron las políticas de reparación. Pero la justicia en Chile demoró en llegar: este proceso inició en 1998 con la interposición de la primera querella contra el exdictador Augusto Pinochet. En el año 2017 se cumplen 44 años del golpe militar, pero las consecuencias de las violaciones a los derechos humanos siguen estando vigentes. Cuatro décadas después, todavía se están investigando juicios de derechos humanos por el poder judicial. La Corte Suprema ha condenado a los principales responsables a penas de cárcel. En este trabajo se presenta el caso de Marcelo Concha, un joven militante comunista desaparecido en 1976. En 2016, sus familiares obtuvieron justicia al condenar la Corte Suprema a los responsables de este crimen, todos exagentes de la dictadura. Las políticas de verdad y justicia que se han realizado a 44 años de sucedidos los hechos son exigencia y requisito para una democracia consolidada que garantice un “nunca más” sobre esos hechos similares.
El 23 de julio de 1975 diarios chilenos dieron a conocer la noticia de que 119 militantes de izquierda habían sido asesinados. Se informaba un listado de nombres de hombres y mujeres. Todos habían participado de un enfrentamiento grupal, del que nadie sobrevivió en Argentina. Los diarios tomaron como fuente la información la revista argentina Lea y el diario de Brasil, O'Día. Estos datos se replicaron por los diarios chilenos, sin hacer un testeo sobre esas publicaciones. Ningún medio chileno averiguó que esas publicaciones eran falsas.Lo único verdadero eran los nombres, eran 119 chilenos que habían sido detenidos por agentes de la dictadura. 119 personas por las cuales sus familiares habían interpuesto recursos de amparo, para exigir conocer su paradero. La prensa entregó dos listados, listas que sumaban 119 nombres. La publicación de este listado fue una señal para sus familiares. Ellos tenían como últimas noticias la detención y desaparición de su familiar. Ahora supieron con nombre y apellido que su familiar estaba en un listado. Este montaje comunicacional se denominó "Operación Colombo" y tuvo como motivación, dar una explicación sobre el destino de un grupo de detenidos entre 1974 y 1975. Este montaje respondió al intento de la dictadura de imponer una "falsa verdad" para desinformar a la opinión pública.Estas noticias describían a estas 119 personas como "subversivos" o "terroristas". La dictadura a través de su agencia de seguridad, la Dirección de Inteligencia Nacional (DINA), pretendió un montaje. Una mentira transformada en una noticia, para desinformar a la opinión pública chilena sobre el destino de aquellas personas que habían sido detenidas por los agentes de la DINA y que se encontraban desaparecidas. Este listado confirmó que estas 119 personas habían sido detenidas por agentes del Estado. Luego de la publicación, el Comité Pro Paz junto con los familiares exigieron a los tribunales tener noticias sobre estas 119 personas cuyos nombres estaban en el listado. Pero no hubo una respuesta de parte del Poder Judicial, el recurso de amparo fue rechazado.Al regreso de la democracia, los familiares de los 119 siguieron exigiendo, verdad y justicia. En Chile el 11 de marzo de 1990 se inició un periodo de democracia. Para Steve Stern fue el inicio de una serie de etapas donde han existido conflictos por un imponer un discurso en relación con las violaciones a los derechos humanos cometidas durante la dictadura. Se ha realizado una batalla entre distintas memorias que pretenden ser aceptadas por la sociedad en su conjunto. Estas memorias han estado, a lo largo de los años en construcción, aludiendo a que van aumentando su acervo a través de hechos políticos y sociales a lo largo de los años.
