We współczesnych państwach istotną część zadań publicznych wykonują samorządy. Podobnie jak i w przypadku innych instytucji władzy, zadania swe wykonują za pośrednictwem organów. W artykule podjęto analizę relacji pomiędzy organami gminy – podstawowej jednostki samorządu terytorialnego. Przedstawiono, jak zmiany w prawie wpływały na pozycję i zakres kompetencji organu stanowiącego – rady gminy oraz wykonawczego − początkowo zarządu gminy, a następnie wójta (burmistrza, prezydenta). Przekładały się one również na ich wzajemne relacje. Przyjęto tezę, że współpraca organów gminy zależy nie tylko od rozwiązań instytucjonalno-prawnych, ale i od innych czynników, w tym układu sił, jaki się ukształtuje we władzach w wyniku wyborów. W oparciu o ten czynnik zaproponowano trzy modele wzajemnych relacji – idylliczny, optymalny oraz konfliktowy. Opisują one zalety i wady różnych stylów współdziałania organów gminy, które mogą się wytworzyć mimo jednakowych dla wszystkich ram prawnych.
The systemic transformation in Poland affected virtually all spheres of the country’s social and economic life.One of its important elements was the restitution of the local government, which was both the object andthe subject of the transformation processes. Based on the analysis of statutory regulations regarding thestrengthening of the position of the executive body of the municipality, the paper confirms the thesis thatthe municipal government was subject to system transformation and that it maintained its subjectivity in theprocess of introducing new systemic solutions.The analysis used the institutional and legal analysis method, as well as the comparative and behavioralmethod.
The meaning of situational context in public policy at the local levelPublic policy is carried out at various levels of public authority. Among the entities involved in its implementation an important role is played by local government units, especially communes. The differentiation of the potentials of communes is the reason why in the same legal and institutional conditions various communes have different possibilities for the realization of their “own” public policy. These differences constitute a situational context, characteristic for each commune. The article analyzes the impact of this context on one of the levels of public policy set apart by B. G. Peters — programming. The thesis: Situational context seen as a set of multi-dimensional local determinants plays a key role in the programming of local public policies has been adopted and verified positively.
