Miszellen, [Ein Beitrag zur Geschichte der Breslauer Diözesansynoden.]*) 1855 gab M. v. Montbach die Statuta synodalia dioecesana sanctae ecclesiae Wratislawiensis heraus. 1 ) Diese Edition entsprach schon zur Zeit ihres Erscheinens nicht den Anforderungen der Wissenschaft. 2 ) Montbach selbst hat zugegeben, daß er nur ein Handbuch für die Praxis habe schaffen wollen, weil es bis dahin noch keine Statutensammlung gab, und hat für eine etwaige 3. Auflage die Beseitigung von Mängeln in Aussicht gestellt. 3 ) Diese 3. Auflage ist nicht erschienen. Auch von anderer Seite ist eine Gesamtausgabe der schlesischen Diözesanstatuten nicht veröffentlicht worden. Nur über einzelne Synoden liegen einwandfreie Arbeiten vor. 4 ) Deshalb setzt eine wissenschaftliche Darstellung der Geschichte der Breslauer Diözesansynoden eine gründliche Bearbeitung des Quellenmaterials voraus. E. Brzoska hat sich in seinem Buche über die Breslauer Diözesansynoden bis zur Reformation, ihre Geschichte und ihr Recht 5 ), dieser Aufgabe unterzogen. Leider stößt man bei der Durchsicht des ersten Teils dieser Arbeit (Die Geschichte der Breslauer Diözesansynoden) auf zahlreiche Fehler, die immer wieder beweisen, daß der Verfasser den vielseitigen Anforderungen, die die exakte Interpretation der Quellen an den Bearbeiter stellt, nicht gewachsen ist. Bald verkennt er die Bedeutung einer eigentümlichen Redewendung oder Bezeichnung, bald kommt er aus Unkenntnis eines Brauches zu falschen Folgerungen; in einzelnen Fällen reicht auch die Kenntnis der lateinischen Sprache nicht aus.®) Stichproben ergeben überdies, daß die bisher noch unver-*) Vgl. den vorigen Band dieser Ztschr. can. h. c. (München) Nikolaus Hilling in Freiburg i. Br. gestorben. Er stammte aus dem Einödshof Hilgen bei Lathen. Als seinen Geburtsort gab er bei seiner Immatrikulation Niederlangen (Hannover), als seinen Geburtstag den 27. November 1871 an. Nach seinem Abiturientenexamen am Gymnasium zu Meppen studierte er vom Sommersemester 1892 ab in Freiburg i. Br. (bei Heiner, Kraus) und Münster (bei Sdralek, Pohle, Mausbach) katholische Theologie. Nach seiner Priesterweihe (1895) und einigen Monaten Seelsorgstätigkeit widmete er sich vom Wintersemester 1896/97 ab in Münster dem Studium der Geschichtswissenschaft und wurde auf Grund seiner von Heinrich Finke betreuten Arbeit über "Die westfälischen Diözesansynoden bis zur Mitte des 13. Jahrhunderts. Ein Beitrag zur geistlichen Verfassungsgeschichte der Bistümer Münster, Paderborn, Osnabrück und Minden" (Lingen 1898) zum Dr. phil. promoviert. Sein fünfsemestriges Studium der Rechtswissenschaft absolvierte er in Berlin, wo Hinschius und von Gierke seine Lehrer waren; nur im Wintersemester 1898/99 war er wieder in Freiburg, um bei Ulrich Stutz deutsche Rechtsgeschichte und zugleich Kirchenrecht zu hören. Mit einer Untersuchung über "Die Entstehungsgeschichte der Münsterschen Archidiakonate" (Münster 1902) erwarb er in Münster den theologischen Doktorgrad und knapp zwei Monate später in Freiburg den juristischen auf Grund einer Dissertation "Beiträge zur Geschichte der Verfassung und Verwaltung des Bistums Halberstadt im Mittelalter. 1. Teil: Die Halberstädter Archidiakonate" (Lingen 1902). Zunächst hatte es den Anschein, als ob Hilling der Rechtsgeschichte treu bleiben würde. Er veröffentlichte eine Untersuchung über "Die bischöfliche Banngewalt, der Archipresbyterat und Archidiakonat in den sächsischen Bistümern" [AKKR. 80 (1900) 80-114, 323-345, 443-468, 645-664 ; 81 (1901) 86-112]. Nach einem mehrmonatigen Aufenthalt in Rom (1903/04) würdigte er den Rotarichter Felinus Sandeus [ebd. 84 (1904) 94-106] ; es folgte die Studie über "Die römische Rota und das Bistum Hildesheim am Ausgang des Mittelalters (1464-1513) [Reformationsgesch. Studien und Texte H. 6 (Münster 1908)]. Als Hilling später das AKKR. herausgab, veröffentlichte er den größten Teil seiner römischen Materialsammlungen: "Die Regesten der Rotaprozesse aus den Diözesen Halberstadt [AKKR. 95 (1915) 33-77], Münster [ebd. 201-264], Osnabrück [ebd. 389-421], Paderborn [ebd. 579-611] und Minden [ebd. 96 (1916) 3-27], und fügte eine Übersicht über die Prozeßgegenstände und die Prozeßparteien [ebd. 193-202] sowie ein Verzeichnis der in den Prozeß-Brought to you by | University of Glasgow Library Authenticated Download Date | 7/1/15 8:50 AM
