O processo penal internacional combina elementos das tradições acusatórias e inquisitórias, assim constituindo um paradigma único. Em razão da escala mais ampla e da maior complexidade da criminalidade internacional a ser enfrentada pelos Tribunais criminais internacionais, pode ser interessante observar os seus desenvolvimentos e históricos diante da temática da admissibilidade probatória. Neste artigo pretende-se analisar a legislação e a prática dos Tribunais Internacionais Militares, os Tribunais Penais Internacionais para a antiga Iugoslávia e para Ruanda, e o Tribunal Penal Internacional, além de apontar comentários gerais sobre admissibilidade da prova em uma perspectiva internacional ampla, ou seja, não somente limitada a órgãos judiciais internacionais de caráter penal.
Einige Überlegungen zur Rolle des Sicherheitsrats in der Völkerstrafgerichtsbarkeit
I. EinleitungZwölf Jahre nach der Annahme des Römischen Statuts 1 fand in der ugandischen Hauptstadt Kampala vom 31. Mai bis 11. Juni 2010 die erste Überprüfungskonferenz des Internationalen Strafgerichtshofs statt. Hauptziel der Konferenz war die Diskussion von Änderungsvorschlägen des Statuts. Die Errichtung des ständigen Internationalen Strafgerichtshofs stellt eine Krönung der Entwicklung der Völkerstrafgerichtsbarkeit dar. Eine wichtige Rolle in diesem Prozess spielte und spielt weiterhin der Sicherheitsrat der Vereinten Nationen. Die Beteiligung des Rates könnte durch die direkte Verbindung zwischen der Bekämpfung der Straflosigkeit und der Wahrung des Weltfriedens und der internationalen Sicherheit erklärt werden 2 . Ein internationales Verbrechen bildet mindestens eine Gefahr für den internationalen Frieden und könnte deswegen durch den Sicherheitsrat behandelt werden. Ziel der vorliegenden Arbeit ist es, einen Beitrag zur Debatte über die Politisierung des Gerichtshofs und seine Unabhängigkeit zu leisten. Der Internationale Strafgerichtshof könnte als ein Instrument für die Wahrung des Friedens und internationalen Sicherheit betrachtet werden 3 . Die Präambel des Römischen Statuts weist deutlich darauf hin, dass schwere Verbrechen den Frieden, die Sicherheit und das Wohl der Welt bedrohen 4 . The present study analyses climate change from the perspective of the law of armed conflict. Climate may be both a victim and a means of warfare. Arguably, the existing normative framework is broad enough to allow for accommodating climate change. It cannot be denied that the environment is easily harmed, or at least jeopardized in times of armed conflicts. Despite the obvious lack of explicit references in the instruments of international humanitarian law, it may be argued that it is possible to fit climate change in. The accompanying analysis addresses the respective potential and the ensuing hurdles.
Artykuł odnosi się do tendencji regionalizacji międzynarodowego sądownictwa karnego, jak np. planów rozszerzenia jurysdykcji Afrykańskiego Trybunału Sprawiedliwości oraz Praw Człowieka i Ludów, z perspektywy zasady komplementarności. Opracowanie zmierza do udowodnienia, że tradycyjne rozumienie komplementarności (jako alokacji jurysdykcji pomiędzy Międzynarodowym Trybunałem Karnym a sądami krajowymi) można rozwinąć tak, aby uwzględnić także regionalne trybunały karne – jako szczebel pośredni pomiędzy stałym MTK a sądownictwem krajowym. Ze względu na zachodzące na siebie – choć nie tożsame – zakresy jurysdykcji, można potraktować MTK i trybunał regionalny jako potencjalnych partnerów, a nie konkurentów, w sądzeniu zbrodni międzynarodowych.
