Indonesian investment continues to develop as a result of globalization and the modernization of the company's operational activities. This is indicated by the large number of technologies used in the production and distribution processes of companies, both domestic companies, multinational companies, and foreign companies. Indonesia's investment ecosystem is not only focused on increasing foreign investment, but also focusing on increasing domestic investment. The Government of Indonesia issues these policies as contained in the Law of the Republic of Indonesia Number 11 of 2020 concerning Job Creation (hereinafter as the Job Creation Law). This change in the investment ecosystem results in a wage system related to the company's operational activities that are effective and efficient or the number of products produced by the company. The investment and the wage system must be carried out like industrial relations based on the meaning of the precepts in Pancasila. In fact, Pancasila industrial relations are not applied properly and correctly in the relationship between employers and job recipients. This paper uses normative legal research methods using only secondary legal materials. The approach used in this paper is a legal approach and a conceptual approach. This research will produce findings about the investment ecosystem, the wage system, Pancasila industrial relations, articles of the Job Creation Law related to the topics raised in the research. This research will also produce a correlation between the investment ecosystem and the wage system within the framework of Pancasila industrial relations in accordance with the Job Creation Law.
There are many Indonesian workers who work in the marine and fisheries sector on foreign ships because their wages are four times the wages of working on Indonesian ships. By reason of high wages often the possible consequences that will occur are ignored. As a result, many undesirable things happened such as human trafficking, torture, ill-treatment, and even murder, as happened on the Chinese ship Fu Yuan Yu 1218 against the victims of Indonesian crew members. This research was conducted to determine the form of accountability from the Indonesian government in the case of the crew of the ship. This research method is a normative juridical method with a qualitative approach and indirect observation and documentation. The findings of this research are in the form of an international legal basis regarding the rights of Indonesian crew members on foreign ships. In addition, this research also seeks legal protection from the Indonesian government based on national law for Indonesian crew members who work on foreign ships. This research is expected to contribute to providing new information regarding the implementation of Indonesian crew work on foreign ships.
It is a book review of a book entitled “Ahli Waris Pengganti, Pasal Waris Bermasalah dalam Kompilasi Hukum Islam” that is written by Ahmad Zarkasih, Lc. It consists of 5 chapters and contains problematic inheritance articles in. It is published by Rumah Fiqih Publishing, which is located in Kuningan, South Jakarta. This book is the first print that was printed on August 22, 2019 yesterday. The purpose of the author regarding this writing is to give information about articles of troubled inheritance. As the main discussion, this writing discusses Article 185 in Compilation of Inheritance Law that contains materials of substitute heirs. It explains Article 173 and Article 194 (1) as a complement in examining that Article. It also gives argumens and criticals of thought of experts, especially Prof. Hazairin who triggered Article of troubled inheritance regarding this book entitled “Hukum Waris Bilateral Menurut al-Qur’an”.
Problems in the labor law sector in Indonesia cannot be separated from the increasing number of foreign workers which are feared to take the place and role of domestic workers. This problem almost always exists every year because foreign investment enters Indonesia while bringing in foreign workers as expert workers or genuine workers from the investors' countries of origin. The entry of foreign workers is a trigger for disputes between foreign workers and domestic workers. As it is known that the Indonesian population is very large, which can be seen from the annual data of the national statistical center, while the high population is not matched by a large number of jobs, resulting in unemployment and regional economic inequality. Based on this background, the problem of foreign workers is related to the renewal of the Law of the Republic of Indonesia Number 11 of 2020 concerning Job Creation (herein after referred to as the Job Creation Law) and its implementing regulations. This paper uses a normative legal research method using legal sources from secondary legal materials. This legal research uses a legal and conceptual approach with a focus on regulations and concepts or theories or principles related to the research topic. This paper presents problems in the new regulation on foreign workers after the enactment of the Job Creation Law. In addition, this paper presents its solution efforts to overcome these problems in Indonesia. This paper uses a normative legal research method using legal sources from secondary legal materials. This legal research uses a legal and conceptual approach with a focus on regulations and concepts or theories or principles related to the research topic. This paper presents problems in the new regulation on foreign workers after the enactment of the Job Creation Law.
