This article will be divided into two parts. First, I will demonstrate the importance of comparative law and legal culture by highlighting the “great principles of French public law”. I will then explore some of these major principles, based on the French and German conceptions of law, justice, the State, and democracy.

Le constat de sa persistance n’en suscite pas moins un étonnement, apte à interroger les constitutionnalistes, plus encore lorsqu’ils enrichissent leur regard critique d’une dimension comparée. La contribution proposée intègre une perspective franco-allemande pour porter un triple regard critique, visant successivement : la catégorie elle-même, laquelle échoue à s’imposer pour dépasser la distinction binaire qui oppose régimes parlementaires et présidentiels ; la problématique plus large des catégories constitutionnelles ; et, enfin, la V e République, objet privilégié des études françaises sur le semi-présidentialisme.
