L'ouverture des archives du Conseil constitutionnel a permis d'initier un travail de recherche sur ses délibérations qui s'est traduit par une analyse des vingt-cinq premières années ayant donné lieu à une première publication (1). Chaque année, de nouvelles sources s'offrent au public et la présente contribution s'inscrit dans l'effort d'ouverture et de transparence mené par la Conseil constitutionnel pour faire connaître le raisonnement des décisions rendues il y a maintenant plus de vingt-cinq ans. La recherche menée ici l'a été par la même équipe que celle qui avait analysé les délibérations rendues durant la période de l'alternance politique de 1981. Elle nous a permis de vérifier la continuité ou la novation des raisonnements développés par les membres du Conseil constitutionnel de l'époque au gré des saisines parlementaires. S'il n'y a pas eu à proprement parler de révolution, on constate un certain nombre de phénomènes innovants qui éclairent certaines questions débattues ou discutées à l'époque ou qui permettent aujourd'hui de révéler la permanence de certaines interrogations. 1983 fût politiquement une année où, sous l'impulsion du Président de la République, le gouvernement et l'Assemblée nationale ont poursuivi la mise en oeuvre du programme de réformes annoncé par le candidat F. Mitterand avant son élection. Ce contexte politique donnait le plus souvent à toute réforme législative, indépendamment de son contenu, une signification idéologique qui se radicalisait devant le Parlement (Assemblée nationale et Sénat) et dans les saisines du Conseil constitutionnel où l'on n'hésitait pas à « découvrir » de nouveaux principes constitutionnels ou prétendument constitutionnels. Symboliquement, le débat et l'opposition entre certains principes et règles à valeur constitutionnelle se sont manifestés au sein des délibérations du Conseil constitutionnel où des choix juridiques importants ont du être opérés. On relève également au cours de cette année la confirmation d'une plus grande « juridicisation » des débats, d'une plus grande technicité, d'où cependant les choix et symboles politiques ne sont pas absents. L'ouverture des archives de l'année 1983 a-t-elle révélé des mystères insoupçonnés ? On peut essayer de synthétiser la situation en considérant que si les résultats des décisions sont connus certaines surprises ont pu émerger de la lecture de certaines délibérations. I. Les équilibres au sein du Conseil constitutionnel L'année 1983 aura tout d'abord été marquée par un changement important lié au renouvellement de trois membres du Conseil constitutionnel, dont le président (2). Jusqu'à cette date, le Conseil constitutionnel était composé de membres nommés à l'époque de l'ancienne majorité. Même si certains d'entre eux avaient été nommés par une autorité de nomination d'opposition, les nouveaux membres se sont immédiatement intégrés et le président D.
