Este artigo científico aborda a infraestrutura dos espaços prisionais e objetiva demonstrar novas formas de cumprimento de pena no regime semiaberto, por meio da adoção de medidas sustentáveis. Com a idealização das fazendas verticais nos perímetros penitenciários, é possível propiciar a execução da pena em um ambiente mais humanizado de efetivo trabalho, e isso estará em sintonia com a sustentabilidade ambiental, permitindo-se conciliar a execução da pena com o desenvolvimento humano sustentável, sem que isso vá de encontro com a Lei de Execuções Penais. Entende-se que uma política pública que proporcione essa nova forma de cumprimento de pena, substituindo as obsoletas colônias penais pelas fazendas verticais, permitirá ao detento o cultivo de verduras, legumes e outras atividades agrícolas, ao passo que os produtos finais desse cultivo serão revertidos para alimentação dos demais encarcerados, ou, ainda, adquiridos por atores sociais devidamente cadastrados, que poderão comprar a produção por um preço mais convidativo; inserindo-os, assim, no seu negócio, demonstrando que aquele seguimento social tem compromisso social, melhorando sua imagem com os consumidores em geral, em especial aqueles que exigem do empresariado uma retribuição social pelos dividendos obtidos. Ademais, com a utilização dessa técnica, o detento terá acesso ao alimento sem adição de produtos que possam comprometer sua saúde. De acordo com o art. 1º, III, combinado com o art. 170 da CF, o cumprimento da pena passa a respeitar piamente a dignidade da pessoa humana, com a valorização inata do ser humano, inobstante denota a função precípua do Estado, no que concerne à ordem econômica de estabelecer um desenvolvimento da economia enfatizando e valorizando o trabalho humano, assegurando uma coexistência digna entre a justiça social, proteção ambiental e economia.
Sabe-se que o direito fundamental ao trabalho é um catalizador de realizações humanas e promoção social e essencial para uma vida digna. Por estas características é que pode ser compreendido, no contexto francês e em muitos outros países como um direito humano, e ao Estado cabe o seu reconhecimento, seja por meio do texto constitucional, como na França, ou por meio da Constituição e de regulamentações em outras normativas, como é o caso do Brasil. Este artigo se justifica pela necessidade de análise histórica do texto constitucional francês visto que não há ampla pesquisa sobre o assunto no Brasil, objetivando então uma maior compreensão da estrutura normativa que a França vem proporcionando ao seu direito ao trabalho. Ao final, com escopo no Texto Constitucional gaulês, se conclui e se ensina ao Brasil que os franceses não têm o direito de trabalhar, mas também o dever de o fazer, o que acarreta uma atuação estatal positiva.
O presente artigo dedica-se a uma análise, sob a metodologia de revisão bibliográfica, sobre a efetivação do direito a dignidade humana e a proteção ao consumidor sob a ótima dos direitos fundamentais e os mecanismos de proteção do consumidor no Mercado Comum do Sul – Mercosul. Para tanto, percorre brevemente um histórico das ações tomadas pelo bloco econômico na proteção do consumidor mercosulino desde a sua criação até o projeto de Acordo do Mercosul sobre o direito aplicável aos contratos de consumo, com o objetivo de se analisar a construção das medidas protetivas estabelecidas pelos comitês especializados na matéria do Direito do Consumidor para verificar-se que mesmo que haja uma vontade de se legislar e padronizar o tratamento dos consumidores nos países integrantes do bloco, conclui-se que ainda é necessário um maior aprofundamento da questão, que depende de vontade política, econômica e diplomática.
