The presumption of innocence is defined as one of the key principles of proceedings on the cases of administrative offenses. Using the current legislation, the legal positions of the highest courts of the Russian Federation and the European Court of Human Rights, judicial practice, the author reveals the essence of the presumption of innocence by highlighting the elements of this principle and characterizing their content.
В работе раскрывается система материально-правовых принципов производства по делам об административных правонарушениях, обосновывается необходимость обязательного закрепления принципов в нормах действующего законодательства об административных правонарушениях. Автором высказывается мнение, что объективация принципов производства по делам об административных правонарушениях в законодательстве об административных правонарушениях может осуществляться текстуальным и смысловым способами. The article provides a comparative analysis of views on the ways and forms of consolidating the principles. The position is substantiated that the objectification of the principles of proceedings on the cases of administrative offences in the legislation on administrative offenses is carried out through textual and semantic methods of normative expression. The author presents his own system of the principles of proceedings on the cases of administrative offences and substantiates their importance in determining the grounds for administrative responsibility, imposing a sentence, organizing production, evaluating the legality and validity of decisions taken as a result of the consideration of cases of administrative offenses and the review of decisions made on them.
The essence of the principle of one-time administrative responsibility is considered, its concept and proposals for improving the provisions of the Code of Administrative Offenses of the Russian Federation are formulated. The conclusions are based on the provisions of the legislation on administrative offenses, the legal positions of the highest courts of the Russian Federation, the European Court of Human Rights, a comparative analysis of the current criminal and criminal procedure legislation. The operation of the principle non bis in idem in proceedings on the cases of administrative offenses is revealed by highlighting the material and procedural elements that make up its content.
The paper examines the concept and essence of punishment individualization as a principle of proceedings in cases of administrative offenses. This principle is implemented by consolidating in the Code of the Russian Federation on Administrative Offenses of the ordinary rules for imposing administrative punishment applicable to any administrative offense, and special rules applied to individual administrative offenses and those who committed them. On the basis of a systematic analysis of ordinary and special rules of sentencing, law upholders use such methods of individualization as determining the rules for punishment imposition within the limits of the sanction provided for under the relevant article of the Special Part of the Administrative Code of the Russian Federation and under the laws of constituent entities of the Russian Federation on administrative offenses or the possibility of imposing administrative punishment, the type or size of which is not provided for by sanctions of the relevant provisions. The paper explains the system and content of the criteria of individualization taken into account for the imposition of administrative punishment and the practice of their application. The author considers safeguards for implementation of the principle of individualization of punishment.
Сущность принципа гласности в производстве по делам об административных правонарушениях и его элементыАннотация. Раскрывается понятие гласности как принципа производства по делам об административных правонарушениях. Сущность принципа гласности выражается в требованиях обеспечения рассмотрения дела об административном правонарушении в присутствии всех желающих и свободного получения информации о нем. На основе системного анализа положений Конституции Российской Федерации, норм международного права, Кодекса Российской Федерации об административных правонарушениях и правовых позиций высших судебных инстанций сформулированы элементы принципа гласности, характеризующие его содержание в производстве по делам об административных правонарушениях. Рассматриваются существующие ограничения и исключения из требований открытости в производстве по делам об административных правонарушениях, а также пробелы и противоречия законодательства при реализации принципа гласности. На основе решений по конкретным делам подчеркивается важность законодательных гарантий действия принципа гласности в производстве по делам об административных правонарушениях. The paper provides definitions of the principles and system of principles of proceedings in cases of administrative offenses. Based on the norms of the Constitution of the Russian Federation, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the Code of Administrative Offenses of the Russian Federation and the practice of their application, the author substantiates the position that the principles of proceedings in cases of administrative offenses are, to varying degrees, enshrined in regulatory legal acts constituting legislation on administrative offenses, both directly and indirectly. The system of procedural principles of proceedings in cases of administrative offenses is revealed. The author includes the following principles in this system: open consideration; state language; direct examination of evidence; freedom to evaluate evidence; compulsory consideration of applications; freedom to appeal against procedural decisions; competition and equality of the parties; fair consideration of the case; ensuring the right to defense. The content of these principles having a pronounced procedural nature is formed through a systemic interpretation of the provisions of the Constitution of the Russian Federation, the European Convention on Human Rights, the Code of Administrative Offenses of the Russian Federation, the case law of the Constitutional Court of the Russian Federation and the European Court of Human Rights. The author concludes that, despite the existence of various ways of consolidating the procedural principles of proceedings in cases of administrative offenses, the greatest efficiency of their perception and application will be achieved only when the principles are reflected in a special chapter of the Code of Administrative Offenses of the Russian Federation.
