The development of the current flow of law in Indonesia in the context of law enforcement is unquestionably still evident in the application of positivism in law enforcement, which, of course, with the application of legal positivism is enforced the law that is more important, if one considers that the philosophical goal of the law is the creation of justice, and so on. This is a declaration of Pancasila values in law enforcement in the Indonesian state. In some instances, it appears that the flow of positivism continues to exert a strong influence on law enforcement in Indonesia, which, of course, can affect the values of justice in law enforcement. As stated in Article 24 paragraph 1 of the Constitution of the Republic of Indonesia, in order to realize the Indonesian state as a rule of law, both law enforcement and justice must be properly enforced in the context of judicial power.
This article discusses the implication of technological development on stock trading in the stock markets of Indonesia Stock Exchange. Along with the technological development, the stock trading system in the stock market shows great development, for example the existence of online stock trading system which can be done remotely because it is facilitated by the development of technology and electronics. The stock trading in the capital market becomes easier with the online system. Besides that, the technological development also facilitates the investors to get information relating to stock trading in the stock market, and also the information of companies listing in the stock market.On the other hand, the technological development also brings negative impact to the stock trading in the stock market. The easier process of stocks transaction due to the technological development leads to more violations that happen in the stock trading within the stock market.
This article regards criminological study on ʽcornering the marketʽ practice in securities trading in capital market. Cornering the Market can be considered as creating a pseudo or misleading representation because when the actors do their action creates a representation that securities trading seems to be active and to increase dramatically, viewed from the condition of trading volume market, leading to the increase in the price of securities due to purchasing in large volume and eventually resulting in the decrease due to selling in large volume by the actors of Cornering the Market. In Indonesia, Cornering the Market practice is a crime, the manipulation crime in securities trade. It breaks the provision of Articles 91 and 92 of Republic of Indonesia’s Law Number 8 of 1995 about Capital Market and Article II.9 of Regulation Number II-A about Equity Stock Trading. Considering the provision of Article 104 of Law Number 8 of 1995 about Capital Market, Cornering the Market practice can be threatened with 10-years imprisonment and fine of IDR 15.000.000.000,00 (fifteen billions rupiah).
This study aims to determine the suitability of the judge's consideration in deciding the Violence and Child Molestation Case in accordance with Article 183 of the Criminal Procedure Code and whether the judge's decision is in accordance with the ideality of justice in Indonesia. This research is a descriptive normative legal research. The technique of collecting primary and secondary legal materials used is by studying documents or library materials. Based on the results of research and discussion, it can be seen that the reason for the Panel of Judges to impose the maximum verdict is that the Panel of Judges determined that the Defendant made threats of violence and forced the Child to commit obscene acts. Based on the results of research and discussion, it can be seen that the determination of the Defendant is valid because according to the author there is a suitability of valid evidence to strengthen the position of valid evidence as stated in Article 183 and Article 184 paragraph 1 of the Criminal Procedure Code. Based on the results of research and discussion in this case, the author also sees and looks at the decision issued by the Panel of Judges which according to the author isin accordance with the ideality of legal justice in Indonesia.
