El presente trabajo se elabora a partir de la reflexión personal y el análisis de la literatura jurídica y jurisprudencial lituana, desde una posición crítica sobre la maternidad o gestación subrogada con una extensión de tal análisis al derecho comparado. Los autores de este trabajo pertenecen (junto a otros) a un amplio grupo internacional de investigación que son de diferentes países europeos, latinoamericanos o asiáticos (GIDEPA). El objetivo del trabajo es analizar los aspectos de la regulación jurídica del instituto de gestación subrogada, mediante la aplicación de métodos como la investigación y análisis comparativo de la literatura científica actualizada, la práctica judicial y fuentes online, por los profesores que intervienen en el mismo. Partiendo desde los orígenes y conceptos de la gestación subrogada también se observa y expone la regulación legal (y no regulación) en diferentes e importantes países así como los diferentes efectos legales en cada uno. El trabajo concluye ofreciendo la posición de los autores, ya deslizada a lo largo del trabajo, pero con especial incidencia al final del mismo, en las conclusiones y recomendaciones finales.
Dicho trabajo, se elabora sobre la base de la reflexión personal y el análisis de la literatura jurídica y la jurisprudencia, desde una posición crítica del tema de las relaciones no patrimoniales entre los esposos con al finalidad de determinar su importancia en ordenamientos tan dispares como el colombiano lituano y español, que aún así mantienen un origen común como es su base o raíz romanística pues, incluso en el caso de Lituania, tradicionalmente se incluye como un ejemplo de país perteneciente al sistema de civil law; teniendo en cuenta, además, que los profesores que lo realizamos pertenecemos, junto a otros, a un amplio grupo internacional de investigadores de países europeos, latinoamericanos y asiáticos (GIDEPA). Partiendo del concepto de matrimonio y de familia, se ofrece una interpretación del concepto y los principios de las citadas relaciones personales, y se analizan las diferentes regulaciones y efectos jurídicos de tales relaciones no patrimoniales entre los esposos en Colombia, España y Lituania con mención de la trascendencia del tema en diferentes países de la Unión Europea. El trabajo concluye con la posición de los autores, ya deslizada a lo largo del trabajo, pero con especial incidencia al término del mismo en los apartados de conclusiones y recomendaciones finales.
