Con la adopción en 2015 del Acuerdo de París en materia de cambio climático, se establece un nuevo modelo que pretende una lucha más efectiva contra el mismo. De esta manera, el enfoque bottom-up que se consagra a través de la técnica de las Contribuciones Determinas a Nivel Nacional, supone una obligación de procedimiento a todos los Estados Partes del tratado. Es por ello que, ante la falta de definición del contenido por ser determinado por cada Estado y, por lo tanto, con amplio margen discrecional, parece interesante determinar hasta qué punto, de la determinación de la obligación jurídica internacional, va a surgir una práctica ulterior que ayude a la interpretación del propio instrumento jurídico internacional, conforme a la regla establecida en el artículo 31 de la Convención de Viena sobre el Derecho de los Tratados. Teniendo en cuenta que, una de las características del Acuerdo de París, es su falta de precisión en muchas de sus disposiciones.
Es indiscutible la estrecha relación que guarda el Acuerdo de París de 2015 con el objetivo de desarrollo sostenible número trece, “adoptar medidas urgentes para combatir el cambio climático y sus efectos”. Esta relación, si hablamos de ella desde el punto de vista de la “acción”, podemos incidir en la importancia que tiene la técnica de las Contribuciones Determinadas a Nivel Nacional, pues los compromisos adquiridos por los Estados Partes en el tratado han de conseguirse a través de una serie de acciones a nivel nacional.
El presente trabajo pretende hacer una reflexión sobre la necesidad de una consistencia en la implementación tanto del Acuerdo de París como de la Agenda 2030. En este sentido, se va a realizar un análisis sobre los efectos negativos que, en el cumplimiento de ambos instrumentos jurídicos, pueden producirse si su implementación se realiza de una manera fragmentada y, por lo tanto, sin tener en cuenta las vinculaciones que los objetivos de desarrollo sostenible tienen entre sí y, éstos, con la técnica de las Contribuciones Determinadas a Nivel Nacional, en el marco del Acuerdo de París.
La Directiva Marco del Agua (DMA) como pilar básico de la política de aguas
de la Unión Europea (UE) estableció un nuevo enfoque ecológico en el que se
hace imprescindible la cuantificación del estado y estructura de los
ecosistemas asociados a las masas de agua. Si bien la valoración química para
determinar el estado de las masas de agua superficiales no supone mayor
problema, debido a la dilatada experiencia preexistente, la valoración del
estado ecológico presenta ciertas dificultades técnicas y jurídicas que –a pesar
de que la DMA ya las preveía- aún no han sido resueltas. Es por ello que el
largo ejercicio de intercalibración realizado hasta ahora, intenta resolver las
diferencias técnicas a la hora de establecer metodologías para la valoración de
los elementos biológicos de calidad, que se traducen finalmente en un
problema jurídico –la falta de armonización de definiciones normativas-. La
planificación hidrológica en demarcaciones hidrológicas internacionales puede
suponer un avance en la simplificación del ejercicio de intercalibración. La
Cuenca del Guadiana resulta ilustrativa de esta situación.
