La cuenca del río Ranchería, al norte de Colombia, se caracteriza por su complejidad ecológica y sociocultural, dada la diversidad de ecosistemas que la atraviesan y sus particularidades en cuanto a las condiciones secas que predominan e inciden en las formas adaptativas de la vegetación, así como en las formas de habitar por parte de las comunidades locales y pueblos étnicos. Sobre esa complejidad se construyó la represa El Cercado entre 2006 y 2010, como proyecto estratégico para el abastecimiento hídrico, la adecuación de tierras y la generación de energía eléctrica, que alteró las dinámicas ecológicas de la región, así como la relación simbólica y material de los pueblos Wiwa y Wayúu con sus territorios, frente a lo cual se extraen lecciones sobre los alcances de los mecanismos de participación ambiental en Colombia, concretamente la consulta previa y la acción de tutela. En efecto, si bien estos amparan derechos fundamentales y colectivos, su aplicación y alcances están mediados por las condiciones de contexto que pueden limitar la posibilidad de garantizar la participación efectiva de quienes se ven afectados por proyectos impulsados por actores externos al territorio.
