Realizado por meio de revisão bibliográfica, o texto propõe um aprofundamento nos estudos sobre a utilização da extrafiscalidade como instrumento para a efetivação de políticas públicas - especialmente em âmbito municipal, onde se evidencia um cenário de crescente rigidez orçamentária e escassez financeira. A justificativa na escolha do tema está na progressiva demanda de satisfação de direitos e garantias sociais fundamentais que enfrentam os entes locais sem contrapartida da União e dos Estados, gerando crises desencadeadas pela forma de federalismo fiscal e conclui que a utilização da extrafiscalidade tem previsão constitucional e pode ocorrer de forma extensiva e sistemática.
Por intermédio de um estudo sobre a importância do debate nas esferas públicas para a construção do espaço público, o presente artigo tem como objetivos determinar em que nível o cerceamento da interação entre os sujeitos e desses com o Estado pode interferir na realidade local e também apontar as consequências da atuação insuficiente das esferas públicas enquanto intermediadoras entre a sociedade civil e o Estado. A justificativa dessa análise tem como pano de fundo a constatação da dispensa da oitiva do Conselho das Cidades (ConCidades), instituição parte das esferas públicas, no processo de formulação do Programa Casa Verde Amarela (PCVA). Na presente revisão bibliográfica é analisada a distinção entre o público e o privado, o conceito de espaço público e a existência das esferas públicas e suas funções, abordadas principalmente a partir de uma categoria essencial do pensamento de Hannah Arendt e Jürgen Habermas e traz como resultado a constatação de que se a política, como na visão de Habermas, deve oscilar entre as esferas pública e privada - e segundo Arendt uma não existe sem a outra – a falta de debate prévio sobre o PCVA afastaram os cidadãos de uma democracia participativa e deliberativa.
Este estudo traz uma revisão bibliográfica e análise de dados estatísticos sobre o cenário do acompanhamento do ODS 11.1 no estado de Santa Catarina, com informações sobre os conceitos e os processos de formação, assim como os critérios de classificação dos aglomerados subnormais e sua correlação com os conceitos apresentados para representar os assentamentos precários denominados favelas. A importância desse estudo está em acompanhar qual o cenário atual do estado e compará-los aos resultados estimados para o próximo censo para o alcance das metas estabelecidas de transformar significativamente a construção e a gestão dos espaços urbanos, apresentando as críticas ao atual sistema de classificação. Da análise pode-se concluir que não são suficientes os critérios utilizados para classificar os atuais aglomerados subnormais existentes no país e, por consequência, nos demais entes da federação. O acompanhamento para o alcance dessa meta demonstra que não está surtindo efeitos as políticas públicas atuais e os recursos públicos aplicados nessa área são flagrantemente insuficientes. Por meio da análise do relatório acerca dos aglomerados subnormais até 2019 (IBGE, 2021), na qualidade de antecipação de resultados para o censo 2021, constata-se o aumento significativo do crescimento do número de favelas em todo o país e em todos os estados da federação neste último decênio.
