Досліджуються основні напрями розвитку інституту кримінального проступку, виділяються окремі недоліки та прогалини кримінально-правової регламентації відповідальності за вчинення кримінальних правопорушень. На підставі проведеного аналізу пропонуються зміни до чинного законодавства України, а також авторське бачення подальшого розвитку інституту кримінального проступку в кримінальному праві України. Визначення на законодавчому рівні поняття та кола кримінальних проступків стало логічним кроком реформування системи кримінального права та реалізації Концепції реформування кримінальної юстиції України, затвердженої Указом Президента України від 8 квітня 2008 року № 311/2008 [1]. Вперше в кримінальному законодавстві незалежної України визначено поняття кримінального проступку, а адміністративне правопорушення віднесено до категорії кримінальних проступків. Проте не можна сказати, що з прийняттям законопроекту № 7279-д від 20.04.2018 «Про внесення змін до деяких законодавчих актів України щодо спрощення досудового розслідування окремих категорій кримінальних правопорушень» [2] вирішено всі питання, пов'язані із запровадженням кримінальних проступків, а реформування системи кримінальної юстиції завершено. Зміст цього закону викликає багато запитань, а тому є підстави стверджувати, що це лише перший крок на шляху реформування системи кримінального права в напряму запровадження кримінальних проступків.
The article discusses some problems of military and civilian administrations operating in Ukraine with the aim of maintaining the national security regime. In particular, the authors investigate the social and political reasons behind the decision to create special government agencies, in the form of civil military administrations. In addition to the comprehensive analysis of the relevant legislative framework, reference has been made to the practical functions of these administrations. The study methodology includes a variety of research tools aimed at improving the analysis and a problem-oriented approach. The conclusions are focused on improving the legislative as well as organizational frameworks of civil-military administrations in the Donbass region. In particular, based on the basic principles within the civil society, including the supremacy of civil society over the armed forces, the discussed Law should be effectively renamed as the Law "On civil-military administrations" with a continuous approach, potentially within a specially drafted project. It is suggested to include a chapter of the Law, on military support of civilian authorities and official efforts of reconstruction of public order in certain areas of Donetsk and Lugansk regions.
The aim of this study was to identify problems related to the establishment of criminal liability for providing inaccurate information about the spread of the Covid-19 epidemic, and propose the ways to solve them. To aim involved the following methods: systemic approach, descriptive statistics, comparative approach, descriptive analysis, pragmatic approach, and forecasting. The effectiveness of health authorities’ response to outbreaks of diseases depends on the completeness and accuracy of the information disseminated. In fact, national legislations do not provide criminal liability for providing inaccurate information about the epidemiological situation in a pandemic. Therefore, there is a need to develop Interim Guidelines to ensure the accuracy of information on the epidemiological situation in a pandemic. A rule that criminalizes the provision of inaccurate information or the dissemination of inaccurate information about the incidence in an epidemic and/or pandemic, should be one of the rules on liability for crimes against national security, and should be punishable by imprisonment for a certain period and deprivation of the right to hold certain positions and engage in certain activities. This study is not exhaustive and opens up prospects for further research in this area.
In connection with the numerous facts of violations of the special legal regime of historical and cultural lands, in particular, their illegal development, a number of draft laws have been developed, which increase the responsibility for the destruction of immovable cultural heritage and violation of the traditional nature of the environment. The presented work is devoted to the analysis of legislative initiatives enshrined in the draft law No. 4562 «On Amendments to Certain Legislative Acts of Ukraine Concerning Strengthening Responsibility for the Destruction of Immovable Cultural Heritage and Violation of the Traditional Nature of the Environment», and the correlation of the provisions of this draft law with the provisions of the Criminal Code of Ukraine, the Land Code of Ukraine, the Law of Ukraine «On the Protection of Cultural Heritage». Thus, the draft law is proposed to supplement Art. 197-1 of the Criminal Code of Ukraine «Unauthorized occupation of a land plot and unauthorized construction» with three new parts regarding the unauthorized construction of buildings or structures: in the historical area of historical settlements (Part 5 of Art. 197-1); on the territory of a historical and cultural reserve, a historical and cultural protected area, a world heritage site or in its buffer zone (Part 6 of Art. 197-1); and the acts provided for by parts five and six of this article, if they are committed repeatedly (Part 7 of Art. 197-1). In addition, it is proposed to determine the type and amount of punishment for these acts. The conducted research shows that the criminal law norms described in Art. 197-1 of the Criminal Code of Ukraine, are able to implement a protective function regarding illegal occupation or unauthorized construction on lands of historical and cultural purposes, and therefore there is no need to adopt the law draft No. 4562 «On Amendments to Certain Legislative Acts of Ukraine Concerning Strengthening Responsibility for the destruction of immovable cultural heritage and violation of the traditional character of the environment», which is imperfect in terms of legal drafting methodology. However, a promising direction of scientific research and possible legislative initiatives on the issue under consideration may be the development of measures of criminal legal action against persons who illegally build up the lands on which cultural heritage sites are located.
