Андрій Боднар, студент V курсу юридичного факультету Одеського національного морського університету МІЖНАРОДНО-ПРАВОВЕ РЕГУЛЮВАННЯ ПРОТИДІЇ ЗАБРУДНЕННЮ МОРІВ: СУЧАСНИЙ СТАН ТА ПЕРСПЕКТИВИ РОЗВИТКУ У статті розкриваються питання міжнародно-правового регулювання протидії забрудненню морів. Зауважується, що міжнародно-правове регулювання протидії забрудненню морів має первинний характер у системі заходів для запобігання забрудненням та заходів для зниження рівня вже існуючого забруднення. У статті зазначено, що правовою основою спільних дій держав у сфері міжнародно-правового регулювання протидії забрудненню морів є міжнародні договори й конвенції в галузі охорони морського середовища -універсальні й регіональні, публічно-правові й приватно-правові. Вони визначають міжнародно-правовий режим захисту й збереження морського середовища, права та обов'язки держав під час здійснення заходів стосовно всіх джерел забруднення в усіх морських просторах. Акцентовано увагу на тому, що особливе місце серед міжнародно-правових угод стосовно охорони морського середовища займає Конвенція ООН з морського права 1982 р., яка передбачає правові форми співпраці між державами у сфері протидії забрудненню моря. Положення цієї конвенції згруповані довкола ряду основоположних норм, стосуються практично всіх аспектів охорони морського середовища, охоплюють усі джерела забруднення й поширюються на різні за своїм правовим режимом райони Світового океану.Разом із тим підкреслено й важливий характер регіональних конвенцій, які спрямовані на вузлове вирішення проблем із запобігання забрудненню моря. Адже вразливість морського середовища в різних районах, морях може бути різною, тому рівень встановлених для його захисту стандартів, придатний для більшості морських районів, для деяких районів може виявитися недостатнім. Це й зумовлює встановлення особливих режимів, на які поширюються не лише загальні норми охорони морського середовища, але й спеціальні, так звані регіональні, що встановлюють більш суворі правила та вимоги щодо протидії забрудненню морів.Ключові слова: забруднення моря, протидія забрудненню морів, міжнародно-правове регулювання забруднення морів, універсальні міжнародні акти, регіональні конвенції.
The article extends the previous Hylleberg, Engle, Granger, and Yoo seasonal unit-root test commands (Baum and Sperling, 2001, https://ideas.repec.org/c/boc/bocode/s416502.html; Depalo, 2009, Stata Journal 9: 422-438), which allow for the use of both quarterly and monthly data. It is also possible to choose between ordinary least-squares and generalized leastsquares detrending (Rodrigues and Taylor, 2007, Journal of Econometrics 141: 548-573) procedures to deal with the deterministic part of the process. The command allows for the use of the sequential method proposed by Hall (1994, Journal of Business and Economic Statistics 12: 461-470) and Ng and Perron (1995, Journal of the American Statistical Association 90: 268-281), the adaptation of the modified Akaike information criteria to the case of seasonal unit-root tests (del Barrio Castro, Osborn, and Taylor, 2016, Econometric Reviews 35: 122-168) as well as the inclusion of Akaike information and Bayesian information criteria to determine the order of augmentation of the serial correlation in the augmented Hylleberg, Engle, Granger, and Yoo regression. Finally, the use of the command is illustrated with an empirical application to the case of monthly passenger airport arrivals to Palma de Mallorca.
