The Round Table was organized by the Faculty of Hotel Management and Tourism in Vrnjačka Banja under the auspices of the Serbian Academy of Sciences and Arts (SASA) Research Center in Kragujevac and the University of Kragujevac. The relevance of the topic brought together academics and practitioners, representatives of public authorities, cultural institutions, tourism and hospitality service providers, scientific research institutions, and owners of Vrnjačka Banja villas. A great interest in cultural tourism, especially since the 1990s, has led the academic community to dedicate more attention to this niche of the tourism market.
Unlike individual protection, which is realized within the framework of procedures initiated by consumers themselves, collective protection of consumer interests is achieved indirectly, with the assistance of the so-called qualified subjects, who submit claims on behalf of consumers. In situations where, due to the modern way of life, the risk of a large number of people suffering damage due to the same unlawful actions has increased manifold, the collective protection of consumer interests gains importance. This is the reason why Directive 2020/1828 was adopted, as it aims to increase the level of consumer protection in a qualitatively new way, compared to previous solutions. With reference to the existing solutions on collective protection, which are contained in the Law on Consumer Protection, the article primarily analyses the provisions of the Directive 2020/1828 related to: legal framework for the application of the rules, particularly those that indicate the specifics of collective protection; provisions on qualified subjects; provisions on measures for the collective protection of consumer interests.
The need to provide legal protection to users of financial services at different stages of the contractual relationship (before, during and after the contract conclusion) resulted in the adoption of appropriate regulations at the national and communal level. These regulations stipulate the conditions and manner of exercising and protecting their rights. The subject of legal analysis in this paper are the rules governing certain banking services (deposit agreement, credit card agreement, overdraft agreement), financial leasing services and financial agreements.
Bearing in mind that the tourism and hospitality sector is recently systematically regulated by two new laws - Law on Tourism and Law on Hospitality, this paper provides a review and legal analysis of the rules contained in the previous and current Law on Tourism. The paper covers and analyzes tourism and tourism product development program, designation of tourist space, incentive measures, tourism promotion organizations, travel agencies, tourist professions, rent-a-car services, personal data protection and tourist inspectors.
The subject of the legal analysis in this paper are obligations of the travel organizer prior to the conclusion of the contract (pre-contractual information duty) and after the contract conclusion (obligations regarding the form and content of the contract, changes of the package travel contract terms, transfer of the package travel contract to another traveller, insolvency protection, confidentiality, provision of assistance to the traveller). Rules on pre-contractual and contractual obligations are considered through a comparative analysis of the provisions contained in the Consumer Protection Act and newly adopted Directive 2015/2302/EU, by taking into account other relevant rules at the national and EU level.
