<p>El artículo consigna un ejercicio de revisión jurídica sobre las características del modelo de economía social de mercado, reconocido como modelo económico por la Corte Constitucional, dentro del subsistema constitucional económico colombiano. La primera parte del escrito detalla las particularidades e implicaciones de este modelo y las consecuencias que su estructura supone para la libre competencia económica, habida consideración del marco normativo de protección. Posteriormente, se describen las generalidades de los sistemas de protección del derecho a la competencia anglosajón y europeo tomando como referencia las normas más importantes en cada uno de ellos, con el fin de comprender el impacto que dichos sistemas tuvieron en el modelo colombiano. Por último se presentan las propiedades más relevantes del régimen de protección de competencia en Colombia a partir de un bosquejo general del marco normativo existente.</p>
Resumen: *** La ordenación de la economía a lo largo de la historia constitucional republicana colombiana (hasta 1991) se ha caracterizado por la inclusión de múltiples artículos con contenido económico en las constituciones que, en todo caso, requerían del desarrollo legislativo para generar contenido vinculante dado el carácter programático de las Constituciones. Esta circunstancia sufrió una modificación relevante con la Norma de 1991 en la que, dado su naciente valor normativo, la Constitución económica cobró una relevancia inusitada. A pesar de la inexistencia formal o expresa de un sistema económico en la Constitución colombiana de 1991, la Corte Constitucional, como intérprete de la Norma Fundamental, ha construido un precedente más o menos consolidado que ha reconocido, materialmente, a la Economía Social de Mercado como el sistema constitucional económico. A esta conclusión se arriba a partir de la interpretación armónica y sistemática del amplio clausulado económico con contenido abierto y flexible de la Norma Fundamental. Este artículo presenta, a través de la construcción de una línea jurisprudencial, el devenir argumentativo que ha permitido adoptar esta posición partiendo de la premisa de la necesidad de un Estado ampliamente interesado
El artículo describe, a partir de una metodología deductiva, una revisión del principio-derecho de la libre competencia económica con un enfoque de derecho constitucional. Para abordar su estudio se analiza el mercado, como institución en la que se enlazan derechos y garantías de contenido económico. Para tal efecto, se abordan las diferencias entre competencia económica, libre competencia y concurrencia. Posteriormente, se presenta un estudio de la importancia que el ejercicio de las dos primeras supone para el impulso del libre desarrollo de la personalidad, como elemento esencial para el perfeccionamiento y realización del plan de vida de los individuos. Finaliza el artículo con un análisis de las características que el mercado -como institución- ostenta para el desarrollo de los derechos de contenido económico.

La primera parte presenta las condiciones generales de mercados competitivos, sus particularidades y características. Posteriormente, se hace un análisis de las imperfecciones de mercados no competitivos, las fallas del mercado, y culmina con una muy breve descripción de las causas de la regulación del Estado a partir de las condiciones de mercado presentadas.</p>
