Os crimes sexuais fazem parte do grupo dos delitos difíceis de provar e as estatísticas de impunidades relacionadas a eles são altas. Nesse contexto, a jurisprudência nacional tem seguido o caminho da flexibilização do standard probatório , considerando a palavra da vítima suficiente para condenação. O presente estudo analisa o seguinte problema: é constitucionalmente viável e é eficaz, pela perspectiva de política criminal, um rebaixamento de standard com o objetivo de reduzir a impunidade? Argumentou-se que a atenção especial conferida à palavra da vítima deve significar a compreensão do contexto de dificuldade de obtenção de provas, o esforço para se verificar a coerência externa a partir dos elementos fáticos que efetivamente podem ser obtidos em cada caso e uma avaliação desprovida de estereótipos de gênero. Mas uma condenação deve pressupor confirmação sólida da hipótese acusatória por elementos independentes. A adoção de uma presunção de veracidade não é compatível com a presunção de inocência e implica uma politicamente problemática conformação com condenações equivocadas, além de sequer impactar positivamente nas estatísticas de incidência do crime. Há espaço para se melhorar a qualidade da prestação jurisdicional, mas o foco das políticas públicas deve estar sobretudo na prevenção e no combate aos fatores sociais e estruturais que estão na raiz do problema.
