Kebutuhan manusia saat ini semakin beragam dan berbagai bentuk perjanjian menjadi pilihan antara lainpenjanjian jaminan fidusia. Bilamana pihak pemberi fidusia (konsumen) melakukan wanprestasi atau tidak tertib dan tidak lancar memenuhi kewajiban angsuran utangnya kepada penerima fidusia (pelaku usaha), maka pelaku usaha dapat melaksanakan eksekusi sendiri atas objek jaminan fidusia yang berada dalam kekuasaan pemberi fidusia. Proses eksekusi objek jaminan fidusia yang seringkali menimbulkan permasalahan sehingga dilakukan uji materi ke Mahkamah Konstitusi sehingga lahir Putusan Mahkamah Konstitusi No.18/PUU-XVII/2019 tanggal 06 Januari 2020.Penelitian menunjukkan klausula yang disiapkan pelaku usaha dalam bentuk perjanjian baku menjadikan konsumen wajib mengikuti keinginan pelaku usaha, bahkan terdapat kecenderungan hak-hak konsumen yang sudah tegas diatur dalam peraturan perundang-undangan diabaikan pelaku usaha. Pelaksanaan eksekusi atas objek jaminan fidusia yang diatur dalam berbagai peraturan perundang-undangan belum dilaksanakan secara konsisten dan masih mengandalkan keinginan pelaku usaha dengan menggunakan petugas eksternal. Setelah Putusan Mahkamah Konstitusi No.18/PUU-XVII/2019 tanggal 06 Januari 2020, sekalipun kaidah yang terdapat dalam Pasal 15 ayat (2) dan ayat (3) Undang-undang No.42 Tahun 1999 tentang Jaminan Fidusia diubah dengan menghargai konsumen, namun dalam kenyataannya masih terjadi pengambilan/penarikan kendaraan secara paksa. Pelaksanaan eksekusi dalam Putusan MK tersebut mempersyaratkan jika pemberi fidusia (konsumen) enggan menyerahkan objek jaminan fidusia, maka pelaku usaha mengajukan permohonan eksekusi ke pengadilan seperti layaknya eksekusi putusan pengadilan pada umumnya. Tujuan penelitian ini untuk mengetahui pandemi Covid-19 sebagai bencana nasional non-alam untuk dijadikan alasan force majeure dalam perjanjian. Penelitian ini merupakan penelitian normatif yang didasarkan pada data sekunder. Penelitian ini merupakan penelitian normatif dengan menggunakan data sekunder. Metode pendekatan yang digunakan adalah pendekatan konsep. Teknik pengumpulan bahan hukum diperoleh melalui penelusuran kepustakaan, dan metode analisis data deskriptif kualitatif. Hasil penelitian menunjukkan, pandemi Covid-19 yang ditetapkan sebagai bencana nasional non-alam kaitannya sebagai dasar force majeure yang berimplikasi pada pembatalan perjanjian. Akan tetapi, pandemi Covid-19, tidak dapat secara langsung dijadikan dasar ketidakmampuan salah satu pihak untuk melaksanakan kewajiban, tentunya perlu pembuktian ketidakmampuan tersebut disebabkan secara langsung pengaruh Covid-19. Oleh karena itu, pandemi Covid-19 dapat dimasukkan dalam klausula perjanjian force majeure relatif.
This paper explores the good faith of the parties through the Cash on Delivery (COD) payment method, which is a payment system method done at the destination place. Good faith is basically a universal principle that emphasizes the responsibility and honesty of the parties in conducting transactions. The parties involved in buying and selling online through COD payment are based on good faith. In purchasing with COD, the parties (seller, buyer, marketplace, expedition service, and courier) must fulfill their respective obligations honestly as a form of the implementation of good faith. The implementation of the principle of good faith by the parties will certainly give confidence to each party so that it has an impact on the development of buying and selling online with the COD payment method.
Tujuan penelitian ini adalah untuk: (1) Menganalisis efektivitas pertanggungjawaban pidana terhadap pelaku usaha yang memproduksi dan memperdagangkan kosmetik ilegal berbahaya ditinjau dari Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen; dan (2) Menganalisis faktor-faktor yang mempengaruhi efektivitas pertanggungjawaban pidana terhadap pelaku usaha yang memproduksi dan memperdagangkan kosmetik ilegal berbahaya ditinjau dari Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini adalah penelitian deskriptif dengan pendekatan yuridis-empiris. Hasil penelitian menunjukkan bahwa: Penegakan hukum terhadap pelaku usaha yang memproduksi dan memperdagangkan kosmetik ilegal yang berbahaya di Wilayah Polres Pelabuhan Makassar terlaksana kurang efektif. Meskipun demikian, proses penegakan hukum yang dilakukan tersebut sudah mengacu pada ketentuan perundang-undangan yang berlaku, seperti tersangka Sdr. ARFANDY alias ARFANDY BIN MUSTAFA yang terbukti melakukan tindak pidana mengedarkan sediaan farmasi/ kosmetika yang tidak memiliki izin edar, sehingga tersangka dijerat dengan Pasal 197 Jo pasal 106 ayat (1) UU R.I. No. 36 Tahun 2009 tentang Kesehatan, dan juga dijerat dengan Pasal 62 Ayat (1) Jo Pasal 8 ayat (1) UU R.I No. 8 Tahun 1999 tentang Perlindungan Konsumen. Faktor substansi hukum, struktur hukum, budaha hukum, sarana dan prasarana, dan pengetahuan hukum kurang berpengaruh terhadap penegakan hukum terhadap pelaku usaha kosmetik illegal yang berbahaya di Polres Pelabuhan Makassar. The purpose of this study is to: (1) Analyze the effectiveness of criminal liability against business actors who produce and trade dangerous illegal cosmetics in terms of Law No. 8 of 1999 concerning Consumer Protection; and (2) Analyzing the factors that influence the effectiveness of criminal liability against business actors producing and trading dangerous illegal cosmetics in terms of Law No. 8 of 1999 concerning Consumer Protection. This research is a descriptive study with a juridical-empirical approach. The results of the study show that: Law enforcement against businesses that produce and trade dangerous cosmetics that are dangerous in the Makassar Port Police Area is ineffective. Nevertheless, the law enforcement process carried out has referred to the applicable laws and regulations, such as the suspect Br. ARFANDY alias ARFANDY BIN MUSTAFA who was proven to have committed a crime of distributing pharmaceutical / cosmetic preparations that did not have a marketing authorization, so that the suspect was charged with Article 197 Jo article 106 paragraph (1) of Law R.I. No. 36 of 2009 concerning Health, and also snared with Article 62 Paragraph (1) Jo Article 8 Paragraph (1) of Law R.I No. 8 of 1999 concerning Consumer Protection. The factors of legal substance, legal structure, legal status, facilities and infrastructure, and legal knowledge have less influence on law enforcement against dangerous cosmetics business operators in Makassar Port Police
