In the Decision of the Constitutional Court of the Republic of Indonesia Number 97/PUU/2013, it is stated that the handling of The Regional Election disputes is no longer be the authority of the Constitutional Court. This raises a consequences, the Regional Election disputes wil be handled through the Special Judiciary. This study aims to analyze the concept of Regional Election disputes court. This study uses a normative method with statute approach. The result of this study shows that the formation of a Special Judiciary to handle the Regional Election disputes is a necessity because it is a mandate of the Law. In order for the handling of Regional Election disputes can be effective, the Special Judiciary should be under the State Administrative Court.
Saat ini, tindak pidana korupsi diklasifikasikan sebagai extra ordinary crime atau kejahatan luar biasa dengan dampak sistematis. Salah satu upaya penanggulangannya yaitu dengan pembentukan lembaga Negara KPK, maka korupsi di indonesia di tangani tidak hanya kepolisian dan kejaksaaan saja, tetapi juga di lakukan oleh KPK. Tujuan penelitian ini yaitu untuk mengetahui syarat-syarat yang harus di penuhi komisi pemberantasan korupsi untuk dapat menggunakan kewenangannya mengeluarkan surat perintah penghentian penyidikan (SP3) pada perkara tindak pidana korupsi. Metode penelitian yang gunakan adalah merupakan penelitian hukum normatif dengan menggunakan tiga pendekatan, yaitu pendekatan Undang-Undang, pendekatan konsep dan pendekatan perbandingan. Hasil penelitian mengenai KPK tidak memiliki kewenangan dalam mengeluarkan Surat Perintah Penghentian Penyidikan (SP3). Namun, pasca perubahan atau revisi Undang-Undang KPK dalam Melakukan Penyidikan diberikan kewenangan baru berupa penghentian penyidikan atau biasa disebut SP3 sebagaimana di atur dalam pasal 40 Undang-Undang No.19 Tahun 2019 yang mana KPK dapat menghentikan penyidikan yang tidak selesai dalam jangka waktu paling lama 2 (dua) tahun. Sedangkan syarat-syarat dikeluarkannya (SP3) oleh KPK yaitu:1. perkara Tindak Pidana Korupsi yang penyidikan dan penuntutannya tidak selesai dalam jangka waktu paling lama 2 (dua) tahun; 2. Tidak terdapat cukup bukti; 3. Peristiwa yang terjadi bukan tindak pidana.
Background: Though there are vigorous efforts made to fight corruption attitude and behavior, in Indonesia the judiciary sector is still characterized by the existence of rampant widespread corruption acts of crime. For instance, there are many judges who have been caught being bribed across the country. From the available data, of the 19 judges at the Corruption Eradication Commission, 53% are those who make up the Corruption Adhoc judges, while the remaining 47% are career judges. Objective: This research was conducted to determine the corrupt behavior of judges in relation to carrying out their duties and authority in upholding justice. Method: The study applied a normative juridical research method, which established that corruption behavior exhibited by judges in handling cases is still prone to criminal acts of corruption, is detrimental to justice seekers. Conclusion: Thus, the judge's corrupt behavior as the foremost law enforcer can be prevented as early as possible, if justice is to be upheld at a national level.
