Considerando as dinâmicas de migração neste início de século e os possíveis desdobramentos da ausência de nacionalidade para a aquisição de direitos, compreende-se que a lacuna normativa acerca da apatridia é ainda mais nociva a um dos grupos mais vulneráveis da atualidade: as crianças apátridas. A despeito da existência de proteção sobre as crianças em inúmeras legislações nacionais e internacionais, a total ausência de vínculo de nacionalidade e a forma como a infância é relegada ao segundo plano quando da produção normativa – o que acaba por expor esses seres humanos em desenvolvimento, em situação de dupla vulnerabilidade, seja pelos riscos próprios da idade ou pela ausência de proteção, a abusos e aos abalos psicológicos provocados pelo contexto de deslocamento e de privação da própria identidade, não se amoldando à identidade étnica da família, desprovida de documentação e distante do berço natal, e também não se identificando totalmente com a realidade do país anfitrião, ao qual não pertence formalmente – uma realidade que se demonstra frágil frente ao Princípio do Melhor Interesse da Criança, em um mundo cada vez mais móvel.
