This writing is the product of an investigation that is in its first stage and its purpose is to analyze how certain phenomena of social reality impact the lives of boys and girls, generating fear, which implies the violation of their rights. Thus, from this phenomenon, it is necessary to identify the elements that affect the construction of that fear and provide the tools to transform this situation, so that they are used in the construction of peace and social coexistence. To develop this first phase of the study, an applied sample was taken in children from the city of Sogamoso, Boyacá; through surveys in order to determine the factors that affect the construction of fear and determine, how it can be transformed. Into something positive and how the law contributes to the protection of children in these abnormal circumstances
En el contexto del conflicto armado en Colombia se han presentado múltiplesviolaciones de Derechos Humanos que han determinado la persecución de lasmás graves conductas internacionales, entre ellas la desaparición forzada. Desdela perspectiva que vamos a abordar, en el Texto de Michael Sandel titulado -Justicia (Hacemos lo que debemos?)-, más allá de los problemas jurídicos y depolítica criminal que el hecho encarna, en esta ocasión veremos una reflexiónética del problema sin dejar de confrontar sus exigencias legales. El presenteartículo realiza una reflexión ius filosófica sobre los valores y deberes deprotección del ciudadano que se afectan y que comprometen la labor del Estadoen la persecución y represión del crimen de desaparición forzada a partir de suselementos de producción de la conducta. Para tal efecto se realiza unainvestigación de tipo hermenéutica analítica de tipo descriptivo y propositiva.
