Este trabajo ha sido finalista del Premio «Estudios Financieros» 2021 en la modalidad de Tributación. La nueva configuración del recurso de casación en el orden contencioso-administrativo ante la Sala Tercera del Tribunal Supremo (TS) dada por la Ley Orgánica 7/2015, de 21 de julio, ha supuesto un auténtico giro copernicano en la configuración de la jurisprudencia en dicha jurisdicción en lo que se refiere a la supresión de los tradicionales motivos tasados de casación y su sustitución por la noción del «interés casacional objetivo para la formación de jurisprudencia». Va a ser este concepto, denominado la «piedra angular» del recurso por la propia Sala Tercera, en torno al cual se ha de construir una jurisprudencia sobre un ámbito tan amplio y diverso como el derecho administrativo, en el que se incluye el derecho tributario como una parcela del ordenamiento jurídico esencial para el funcionamiento del Estado y que afecta a la práctica totalidad de los ciudadanos en su condición de contribuyentes. El objetivo de este trabajo es revisar cómo ha operado el interés casacional objetivo en la admisión de recursos de casación en materia tributaria, con el fin de conocer las posibilidades que el actual sistema ofrece y definir el criterio de la Sección de Admisión de la Sala Tercera del TS en los últimos años.
En el presente artículo se realiza un estudio de las actas con acuerdo como técnica convencional dentro del procedimiento inspector y como respuesta a algunos problemas de nuestro sistema tributario, entre los que se encuentran la alta litigiosidad y la duración de los procedimientos económico-administrativo y contencioso-administrativo. Para alcanzar dicho fin, se completa el estudio con experiencias procedentes de sistemas tributarios de derecho comparado, tanto de common law como de derecho continental. Este análisis permitirá examinar cómo los mecanismos convencionales han permitido a otras Administraciones tributarias crear una cultura tributaria basada en el acuerdo, reducir la litigiosidad y alcanzar acuerdos más eficientes. Por tanto, a través de esta doble perspectiva se pretenden alcanzar algunas propuestas capaces de inspirar el uso de las actas con acuerdo y otros mecanismos convencionales en nuestro ordenamiento fiscal, partiendo de la necesidad de crear una cultura jurídico-tributaria basada en el acuerdo con una relación cooperativa entre la Administración y el contribuyente.
