Who has the most to lose from climate change in your country? As the driest inhabited continent, with a history of devastating drought, floods, fire and tropical cyclones, Australia has more to lose than most countries from climate change. The most populated areas of Australia are becoming drier, heatwaves and extreme fire weather are increasing, and storms are becoming more intense. Australia's people, economy and iconic ecosystems like the Great Barrier Reef and Kakadu will all lose under a changing climate. Yet Australia's political response to climate change has lagged behind many other countries. Australia was one of the last countries to ratify the Kyoto Protocol, recently removed its newly established price on carbon, and lacks a credible policy to achieve even the modest emission reductions it has pledged.
Amerika Birleşik Devletleri (ABD) ve Meksika arasındaki Pasifik Okyanusu’nda orkinos balıkçılığına ilişkin uyuşmazlıklar, 1990’ların ilk yıllarında başından başlayıp 2019 yılında nihayete ermiş ve uzunca bir süreye yayılarak uluslararası hukuk gündemine etki eden bir mesele olarak ön plana çıkmıştır. Uyuşmazlıkların ilk ayağını ABD’nin Meksika’ya uyguladığı ticari kısıtlamalar oluşturur. Meksika’nın GATT 1947 çerçevesince 1991 yılındaki şikâyeti ile oluşturulan GATT Paneli, Meksika’yı haklı bulmuştur. Akabinde tarafların bir anlaşma çerçevesinde uzlaşmaları ile anlaşmazlıklar bir süre için nihayete erse de ABD’de Federal Mahkeme kararı ile Meksika menşeli orkinoslar için yeni yasaklar uygulanmaya başlayınca mesele 2008 yılında tekrar gün yüzüne çıkmıştır. Bu dönemde Dünya Ticaret Örgütü’nün kurulmuş olması ve Ticarette Teknik Engeller Anlaşması’nın kabulü, uyuşmazlığın boyutunu değiştirmiştir. Uyuşmazlığın uzun zaman alan çözüm aşamaları, 2019 yılında sonlanmış ve nihayetinde karar ABD lehine sonuçlanmıştır. Gerek GATT döneminde gerekse de DTÖ dönemindeki uyuşmazlıklar, sonuçları olduğu kadar çözüm aşamaları ile de önem arz etmektedir. Süreç esnasında uyuşmazlıkların çözümünde değişen usullere tanıklık edilmiş ve iki dönemin uygulama farklılıkları gözlemlenebilmiştir. Bu açıdan mesele, GATT ile DTÖ’nün uyuşmazlık çözüm yollarının karşılaştırılmasını sağlamaktadır. Uyuşmazlıkların kayda değer bir özelliği, ticaretin devamlılığı ve çevrenin korunması ikilemini uluslararası hukuk merkezinde değerlendirme ve zamanla değişen yaklaşımları ele alma imkânı tanımasıdır. Bunların yanında ABD’nin yunusları koruyucu iç hukuk düzenlemelerine diğer devletlerin uymalarını beklemesi, meseleyi uluslararası hukuk açısından değerlendirmeye değer kılmaktadır.
1950 ve 1960’lı yıllarda Japonya’da yaşanan ve metil cıvaya bağlı büyük çaplı zehirlenmelerin yaşandığı, ‘Minamata felaketi’ olarak bilinen olay, cıva ve cıvanın verebileceği zararlar konusunu dünya gündemine taşımıştır. Sonraki dönemde bilimsel çalışmalarla cıvanın insan sağlığına zararları ortaya konmuştur. Bu alanda küresel ölçekte düzenlemelere gidilmesi, ancak içinde bulunduğumuz yüzyılda mümkün olmuştur. 2000’li yılların başında UNEP nezdinde yürütülmeye başlanan çalışmalar, yoğun bir müzakere süreci sonucunda ancak 2013 yılında tamamlanabilmiştir. 2017 yılında yürürlüğe giren Cıvaya İlişkin Minamata Sözleşmesi (Minamata Sözleşmesi), son yıllarda akdedilen küresel çevre korumasına ilişkin yegâne sözleşmelerden biridir. Sözleşme, uluslararası çevre hukuku için oldukça yenilikçi olarak değerlendirilebilecek hususları ele alması ile öne çıkar. Sözleşme, cıvanın üretim, ticaret ve atık bertarafı gibi farklı hususlarını küresel ölçekte ele aldığı gibi; zanaatkarlık ve küçük ölçekli altın madenciliği gibi yerel hususları da içerecek şekilde, cıvanın insan hayatındaki yeri ve kullanımına geniş kapsamlı düzenlemeler getirmektedir. Sözleşme; cıva sorunu ile mücadele için seçimlik yollar önermesi, bireysel olduğu kadar sistematik denetime de izin veren bir yapıya sahip olması gibi özellikleri ile klasik çevre koruma anlaşmalarından ayrılır. Bununla birlikte Minamata Sözleşmesi, diğer uluslararası sözleşmelerdeki tehlikeli madde ve atıklara ilişkin bağlantılı maddeleri kabul etmesiyle de bu alandaki sözleşmelerle iş birliği edebilecek şekilde düzenlenmiştir. Türkiye 2022 yılı itibariyle Sözleşme’ye taraf olmuştur. Minamata Sözleşmesi, uluslararası çevre hukukunun günümüz olaylarına karşı yaklaşımı ile olduğu kadar, geleceğini de anlamak için incelenmesi gereken bir anlaşmadır.
