Este trabajo analiza el régimen legal de los programas de computación que realizan trabajadores. Este estudio se centra en el examen del inciso 2° del artículo 8° de la Ley N°17.336 que precisamente regula dicha hipótesis. Básicamente se tratan dos grandes temas: el primero relativo a la titularidad de los derechos de propiedad intelectual del software, con especial énfasis en la problemática de los derechos morales; y el segundo, sobre las remuneraciones que pueden recibir dichos trabajadores.

Esta clase de pacto se presenta como un tema complejo, toda vez que el trabajador goza del derecho constitucional de la libertad de trabajo, el que se ve afectado por la suscripción de un acuerdo en este sentido. Este trabajo analiza el fenómeno de estas cláusulas en el ámbito laboral, en particular los requisitos necesarios para que sean consideradas válidas a luz del principio de proporcionalidad y las consecuencias que se derivan de su incumplimiento.
RESUMEN: El desarrollo de invenciones se reconoce como un elemento clave del progreso técnico y económico. En su gran mayoría, estas son desarrolladas en el seno de empresas o entidades, que se valen de trabajadores dependientes para enfrentar tales tareas. Los actores principales son, entonces, las partes clásicas de una relación laboral: empleador y trabajador. Se trata de una materia que debe compatibilizar de forma equilibrada ambos intereses, pues si su tratamiento se presenta inadecuado para uno de ellos, puede producir un desincentivo generalizado de la investigación.
