Kunst[ehler. Xrzterecht. Kurp[uscherei.Haberland: Arztliche Kunst~ehler. I. Jur. Wschr. 1932 II, 3304--3305. Nach Ansicht des Verf. mehren sich in letzter Zeit auffallend ~rztliche Kunstfehler, woftir er 1. nicht gentigend fach~rztliche Ausbildung, 2. eine gewisse Sorglosigkeit, weii der Arzt gegen Haftpflicht versichert ist und ftir den Schaden nicht selbst aufzukommen braucht, verantwortlieh macht. HaberIand meint, yon juristischer Seite werde ein Kunstfehler nur anerkannt, wenn Fahrl/~ssigkeit vorliege. Er erkl~rt es jedoch fttr unbiltig, dag Patienten, die dutch feMerhafte Behandlung der )~rzte Sehaden erleiden, keinen Sehadenersatzanspruch erhalten, wenn dem Kunstfehler nicht Fahrliissigkeit zugrunde liegt, und f/ihrt einige besonders gravierende Fs an. Der Richter pflege mangels iirztlieher Saehkenutnis nicht die gesamten Ausfiihrungen des Gutaehters, sondera nur den Sehlul]satz zu lesen. Ferner bezeichnet er es als unbillig, dal3 Kranke, welche auf Kosten eines Wohlfahrtsamtes in einem sts Krankenhans behandelt werden, keinerlei Anspriiche an die Krankenanstalt stellen kSnnen, wenn sie dureh/irztliohe Mal]nahmen in ihrer Gesundheit geschs sin& Besonders wendet er sich dagegen, es als unkollegial zu bezeiehnen, wenn ein gewissenhafter Gutachier die Mal~nahmen eines Kolfegen als ,,Kunstfehler" bezeiehnet. Obgleieh in der s Standesordnung ein Hinweis sich Iinde, dal] vertrauenss Gutachten nicht Gegenstand eines ehrengeriehtlichen Verfahrens sein k6nnen, sei es doeh vorgekommen, dal] man einen Arzt vor einen iirztliehen Ehrenrat br~ehte, weil er in seinem Gutaehten die Mal]nahmen eines anderen Arztes Ms Kunstfehler bezeichnet h~itte. Aber andererseits hiitten sich Klagen und Besehwerden Gesch~idigter nicht in solehem Mal]e geltend gemacht, dab Veranlassung zu solcher gesetzlichen Regelung vorliige. In der Verurteilung falseher KollegiMitiit tritt Verf. Haberland bei, meint jedoch, dab die Ehrengerichte niemMs die objektive Wttrdigung s FeMer verurteilten, sondern nur eigentlieh beschimpfende 3~ul]erungen.
