El presente texto aborda, a modo de ensayo, una revisión analítico-histórica del Derecho Romano y sus aportaciones sustanciales en la tradición jurídica de occidente. Así, sustenta la tesis de que existen otras instituciones y conceptos que han transcendido los contenidos del derecho privado para irradiar la práctica judicial y las instituciones básicas de la cultura jurídica en occidente.
Este artículo aborda y propone soluciones a tres problemas: el de los sujetos legitimados para la interpretación (jueces, legisladores, ciudadanos), el del objeto que se interpreta la Constitución y del modelo y los métodos de interpretación jurídica adecuados para las disposiciones de los textos constitucionales. Sumado a los anterior, se propone una reordenación de los paradigmas de la interpretación constitucional que, si bien parte de la propuesta genovesa que distingue entre teorías cognitivistas, escépticas y eclécticas, se permite introducir una subdivisión en las teorías cognitivistas según las teorías de la verdad, por ello se clasifican en teorías cognitivistas de la correspondencia, teorías cognitivistas de la coherencia y teorías cognitivistas del consenso racional.
