Si Renan fut une des plus grandes figures intellectuelles du XIXe siècle, il est peu à peu tombé dans l’oubli au milieu du XXe siècle, et les études qui s’attachent à faire revivre et diffuser sa pensée se cantonnent essentiellement à l’analyse de son œuvre littéraire ou de sa pensée religieuse. Pourtant, les juristes entretiennent eux aussi sa mémoire par le biais de sa conférence sur la nation. Mais ces pans des analyses consacrées à l’auteur, laissent de côté un large champ, celui de l’influence de ses écrits sur le milieu politique et juridique de son époque. Car ses écrits, par leur publicité, ont parfois directement, parfois involontairement, influencé un régime qui se cherche après la défaite de 1870. Il s’agit donc ici de présenter une part de cette analyse, pour dépouiller l’auteur d’une partie des légendes qui l’entourent, afin de mesurer sa réelle influence dans ce domaine.
