Este artículo es el primer avance en la investigación sobre la propuesta de reforma al Código Civil Colombiano; para ello se parte de la necesidad de realizar una actualización de este estatuto dados los cambios sociales, políticos, culturales, religiosos, éticos y morales de Colombia en los últimos 30 años, aproximadamente. Con la aparición de la Constitución de 1991 la aplicación del derecho tuvo un cambio, pasó de ser un Estado de Derecho a un Estado Social de Derecho, motivo por el cual la aplicación de reglas de tipo moral y ético adquiere importancia, generándose así la obligación de hacer una constitucionalización del derecho privado. La moral es un componente básico de los derechos fundamentales y de las reglas de interpretación para un nuevo esquema y regulación del derecho civil en Colombia. Pensar en ello, además, implica reconocer que estas nuevas normas que se proyectan en la propuesta de código tienen la finalidad de buscar un beneficio en la comunidad, beneficio que consiste en mantener la paz social y de esta forma, tal vez, concebir el concepto de felicidad. En este primer avance, en desarrollo del primer objetivo propuesto en el proyecto de investigación: “Analizar el Código Civil Colombiano frente a la jurisprudencia constitucional y los derechos humanos”, los componentes mencionados son una base en muchas de las sentencias emitidas por este tribunal constitucional, y a la vez, la base para hacer una lectura constitucional del ordenamiento civil para esta nueva época en Colombia.
