El artículo tiene como objetivo conocer los factores que determinan la aplicación de la práctica de prisión preventiva en el estado de Yucatán. Por consiguiente, se analizaron las percepciones de los jueces en relación con dicho fenómeno en el Sistema Penal Acusatorio. A nivel internacional se ha determinado que los supuestos de prisión preventiva en México no son adecuados en un sistema acusatorio y en Yucatán se han incrementado las determinaciones de prisión preventiva durante el periodo 2011 al 2016. La metodología utilizada fue cualitativa de tipo fenomenológica. Se aplicaron entrevistas a profundidad y se analizaron audiencias iniciales en el Centro de Justicia Oral de Mérida. De acuerdo con los datos recabados se encontró que los Jueces de Control en el estado de Yucatán aplicaron la prisión preventiva a los procesados valorando el principio de proporcionalidad y de idoneidad de la medida analizando principalmente el tipo de delito y el arraigo en los procesados en el estado. Por último, la presunción de inocencia se ve amenazada por lo cual se necesitan más estudios para evitar prácticas de justicia discriminatorias y favorecer un mejor equilibrio entre la víctima y el procesado.
