The recent health emergency caused by covid-19 has, in its way, highlighted the fundamental interweaving between law, philosophy and medicine, as well as the need to resort the ancient principles – disclosed by philosophical questions – which must represent the basis of both legal and medical issues.
The present relationship between punishment and the body is the object of the present investigation. This object, in substance, addresses the very purpose of punishment, becoming one of the main points of current criminal law.
Nonostante le grandi conquiste della modernità, nonostante il suo evidente sforzo per collocare l’individuo al centro e il mondo in periferia, il discorso giuridico è nato e si è sviluppato sotto il segno dell’individualismo possessivo. La libertà di ogni individuo può essere legittimamente limitata solo dagli obblighi e dalle forme che sono necessari per assicurare agli altri la stessa libertà. La società consiste in una serie di relazioni mercantili e più in particolare è un’invenzione dell’uomo per la tutela della libertà individuale della propria persona e dei beni e, quindi, per il mantenimento di relazioni di scambio disciplinate tra gli individui, considerati come proprietari di sé stessi. Entrambe le pretese dell’epoca moderna – il diritto è solo diritto privato/il diritto è solo diritto pubblico – non riescono a dare conto delle infinite sfumature di cui si compone la giuridicità. Per questo motivo, l’odierna giustificazione della obbligatorietà delle norme deve essere in grado di integrare le fondamentali acquisizioni del moderno con quei principi essenziali del vivere civile – come, ad esempio, la solidarietà – che la stessa modernità ha messo tra parentesi e rinnegato.

In particular, two different questions require a new and more updated discussion: one is dedicated mainly to what the Law prescribes in a certain place and at a certain time (quid iuris) (Science of Law), and the other, instead, concerns above all justice (quid ius) (Philosophy of Law). It is only from the tension between Law and Justice that the jurist can be reconciled with jurisprudence and fulfill what – in hindsight – is his fundamental task: setting checks and balances to legislation for the protection of human rights.
