ZusammenfassungIm Jahre 2017 legte das sogenannte „Cannabisgesetz“ die Grundlage
für die Errichtung der Cannabisagentur am Bundesinstitut für
Arzneimittel und Medizinprodukte (BfArM). Die Aufgaben der Cannabisagentur
umfassen die Kontrolle und Steuerung des Anbaus und der Herstellung von Cannabis
für medizinische Zwecke in Deutschland. Nach den Regelungen des
Einheitsübereinkommens über Suchtstoffe der Vereinten Nationen
von 1961 nimmt die Cannabisagentur die Cannabisblüten mit der Ernte in
Besitz. Daher ist die Cannabisagentur Inverkehrbringer der
Cannabisblüten als Arzneimittel und agiert als Pharmazeutischer
Unternehmer und Großhändler. Inzwischen sind medizinische
Cannabisblüten, die nach der aktuellen Rechtslage
Betäubungsmittel sind, aus dem Anbau in Deutschland verfügbar
und können von Apotheken bei Vorlage einer individuellen Verschreibung
als Rezepturarzneimittel an Patientinnen und Patienten abgegeben werden.
Für Cannabisblüten als pflanzliches Arzneimittel gelten die
gleichen Ansprüche an eine reproduzierbare pharmazeutische
Qualität wie für andere pflanzliche Arzneimittel.
