In two recently published judgments of the Federal Supreme Court in Germany dating June 23rd, 2004 (IV ZR 130/03) and September 29, 2004 (IV ZR 233/03) the assessment of tinnitus in private accident insurance and particularly the exclusion clause section sign 2 Abs. 4 AUB 88 has been newly defined. This exclusion clause is still valid according to the actual jurisdiction in the case a tinnitus is asserted following an accident without any organic (physical) damage. In this case tinnitus has to be regarded as mental (psychic) reaction in the meaning of paragraph 2 AUB. According to the actual jurisdiction the compensation of tinnitus could be possible, when as physical underlying reason a proved harm in the field of the inner ear or the auditory pathway is found, which can be traced back to the accident according to the rules of causality.
Bei medizinisch-wissenschaftlichen Vorträgen, bei ärztlichen Fort- und Weiterbildungsveranstaltungen, in Fachzeitschriften und auch in der medizinischen Forschung werden regelmäßig Abbildungen von Patienten zur Veranschaulichung von Krankheitsbildern, Behandlungsverfahren oder intraoperativer Situationen verwendet. Dies geschieht in Form der Präsentation von Röntgenbildern, intraoperativen Foto- oder Videoaufnahmen oder Bildern von Körperteilen. Auch bei der Darstellung einzelner ärztlicher Tätigkeiten oder Behandlungsverfahren ist es jedenfalls für bestimmte Eingriffe zulässig, Vorher- und Nachher-Bilder von Patienten auf der Praxishomepage zu veröffentlichen oder in der Praxis oder bei Vorträgen vorzustellen. Die Verwendung und Präsentation solcher Bilder von Patienten oder Abbildungen von Körperteilen ist gerade in der ärztlichen Ausbildung, bei Vorträgen und auch in wissenschaftlichen Publikationen geradezu an der Tagesordnung und selbstverständlich. Dennoch sollte man sich dabei im Klaren darüber sein, dass die Rechte der abgebildeten Persönlichkeiten und derjenigen, welche die Abbildungen (Fotos, Röntgenbilder etc.) hergestellt haben, nicht verletzt werden dürfen. Welche Aspekte hierbei zu beachten sind und wie man sich vor Ansprüchen Dritter auf Unterlassung und Schadensersatz am besten schützen kann, stellen wir im nachfolgenden Beitrag vor:
Zusammenfassung
Hintergrund Schultererkrankungen mit Schmerzen und/oder Bewegungseinschränkungen sind die dritthäufigste physiotherapeutische Diagnosegruppe in Deutschland. Mittels Medical Flossing sollen durch Bewegung unter starker Kompression von Gewebe u. a. diese Symptome verbessert werden.
Ziel Machbarkeit und Prüfung einer Evaluation der Anwendung von Medical Flossing im Praxisalltag hinsichtlich der Belastung und Sicherheit von Patienten sowie der standardisierten Umsetzbarkeit. Generierung von Daten für zukünftige Fallzahlkalkulationen. Dafür werden Effekte und Nebenwirkungen von Medical Flossing bei Patienten mit Schmerzen und/oder Bewegungseinschränkungen im Bereich des Schultergelenks evaluiert.
Methode Die Teilnehmer der Studie erhielten fünf physiotherapeutische Behandlungen, die um eine Behandlung mit Medical Flossing oder mit Sham-Flossing ergänzt wurden. Primäres Outcome war die Funktion der oberen Extremität anhand des Disabilities of the Arm, Shoulder and Hand (DASH), sekundäre Outcomes waren u. a. das Schmerzniveau anhand der Numeric Rating Scale (NRS), das Bewegungsausmaß (ROM) und das Auftreten von Nebenwirkungen. Die Gründe für die Ablehnung einer Studienteilnahme wurden formlos erfasst.
Ergebnisse Insgesamt wurden zwölf Teilnehmer in die Studie eingeschlossen. Weitere Personen haben die Teilnahme aufgrund von Vorbehalten gegenüber der Behandlungsmethode und des zusätzlichen Zeitaufwands durch die Datenerhebung abgelehnt. Funktion und Symptome wurden durch beide Behandlungsformen im Prä-Post-Vergleich positiv beeinflusst (DASH, max. NRS, ROM), statistisch signifikante Gruppenunterschiede existierten nicht. Bei allen Teilnehmern traten Nebenwirkungen auf, besonders Schmerzen und Hautveränderungen. Ernsthafte Symptome wie Kurzatmigkeit wurden vereinzelt in der Interventionsgruppe (IG) angegeben.
Schlussfolgerung Funktion und Symptome wurden durch beide Behandlungsformen positiv beeinflusst, mit einer in Teilbereichen höheren klinischen Wirksamkeit des Sham-Flossings (DASH, max. NRS). Weiterführend sollten der spezifische Effekt des Medical Flossings und das Verhältnis von Wirkung und Nebenwirkung unter Einbezug der Zugstärke der Flossinganlage kritisch untersucht werden. Zudem könnte die Anzahl der Erhebungsinstrumente (funktionelle Armbewegungen, Goniometermessung) reduziert werden, um die Rekrutierung von Patienten zu erleichtern.
