Consequentialist life-maximizing approaches to triaging prescribe that everyone ought to have an equal chance of living a typical lifespan, through the saving more life-years (or saving most lives) principle, which emphasizes the youngest-first principle and in some cases a lottery approach, often at the expense of the old and the sick. Although this approach has already been criticized by several bioethicists, this article provides a different kind of criticism to the life-cycle viewpoint, one thathas not yet been explored at length; namely, we contend that the life-maximizing approach entails a form of racism without racists in its attitude towards Black people. More specifically, we contend that by neglecting the idea that current societies are not post-racial, it privileges White individuals and disadvantages Black people in the triaging process, curtails equal opportunities for Black people, reinforces white normativity, and neglects African culture. We end the article by pointing towards an Afro-communitarian relational triaging approach that does not face the same difficulties as consequentialist life-maximizing approaches do.

El avance en el alcance e interpretación de los derechos ha permitido no solamente que poco a poco se brinden mayores garantías para las personas humanas, tanto a nivel nacional como internacional, sino que se modifique la noción misma de los sujetos de derechos. En este sentido, actualmente, la protección se ha ampliado para cobijar a los denominados seres no humanos, como pueden ser los animales, ríos o plantas. Respecto a estas tendencias cabe preguntarse: ¿este nuevo entendimiento de los derechos se debe a un verdadero cambio de perspectiva que concibe a los seres no humanos como sujetos de derechos? O, por el contrario, ¿las nuevas tendencias reconocen los derechos de seres no humanos porque es posible que los daños a ellos afecten directa o indirectamente a los seres humanos? La respuesta a esta última inquietud es relevante, dado que eso determina tanto el alcance de la protección a los seres no humanos como las formas de reparación. Por ello, el presente texto pretende exponer los derechos de los seres no humanos proponiendo que una visión distinta a la antropocéntrica tradicional, como es la cosmovisión indígena, puede permitir una mejor comprensión de los derechos de los seres no humanos y su derecho a la reparación.

Some philosophers and activists have been sceptical about the relevance of pursuing animal justice to progress racial justice. Routinely, these sceptics have argued that allying animal and racial justice struggles is politically unfeasible, counterproductive, distractive and disruptive for the achievement of racial justice. The conclusion of these sceptics is that animal justice is either a barrier or irrelevant to racial justice and, as such, activists should not ally both struggles. In this article, I wish to contest the arguments that forward the idea that these struggles should not be addressed together, especially in the case of addressing anti-Black racial injustices. I offer a negative argumentative strategy to forward my thesis; namely, I offer reasons to reject the arguments that are sceptical about the relevance of addressing animal justice to achieve progress in racial justice. I contend that racial injustice is partly fuelled by the capacity contract. The capacity contract, in turn, is intertwined with the way humans treat animals. Owing to the fact that speciesism fuels the contract that incites racism, then addressing speciesism is instrumentally relevant for overcoming racial injustices. Moreover, I demonstrate in this article that not only are there various ways that anti-racist and anti-speciesist struggles are interconnected, but also that the project of addressing them together is politically feasible and desirable.
