Undermining European Environmental Policy Goals? The EU Water Framework Directive and the Politics of Exemptions

Abstract: Abstract:The Water Framework Directive (WFD) is the core legislative instrument in the European Union for the protection of water resources. Adopted in 2000, its objectives were to achieve "good status" for water bodies by 2015 and prevent any further deterioration. However, the European Commission and some stakeholders are rather dissatisfied with the implementation of the Directive so far, in particular with the use of exemptions to the environmental objectives. Exemptions are of paramount importance: they m… Show more

“…One obvious effect is the proliferation of hazardous materials, such as polycyclic aromatic hydrocarbons (PAHs), in the atmosphere. PAHs cause great concern because of their mutagenic, carcinogenic, and teratogenic properties, and are designated as priority pollutants in the EU (IARC, 1983;Boeuf et al., 2016). They tend to be associated with particulate matter (PM), soils, and sediments (EEA, 2012;Cassee et al, 2013;Cheruiyot et al, 2015).…”

“…Without this bridge between top-down and bottom-up policy framework, it is not certain that collaboration automatically leads to sustainable outcomes, because there can be vested interests that undermine the effectiveness of EU environmental policies [59]. However, at the same time, the design of the framework around the Danish water council set-up is also a limiting factor.…”

“…The proposed PoM was then forwarded to the Nature Agency as part of the preparations for the second round of RBMPs. In a recent publication, Boeuf et al [59] revealed the existence of several exemption clauses in WFD implementation across member states, which if overused, could undermine the environmental goals of the EU WFD. The fact that many actors-also in a Danish context-potentially could have an interest in undermining the effectiveness of EU environmental policies is not going to be the core aspect in the water council case.…”

“…The WFD is arguably the most ambitious piece of EU legislation in the field of water. The directive defines a framework for IWRM in Europe with a view to achieving 'good water status' by 2015 (now extended to 2021) Boeuf, Fritsch, & Martin-Ortega, 2016). Institutional novelties include the management of water at hydrological scales, public participation, and the use of economic tools.…”
