This paper analyzes effort levels of supervisors, the manufacturers association and the administrative supervision department, and manufacturer in a supply chain management regarding credit system (CS) construction based on two different driving modes using game theory. A whole CS construction, in a supply chain management system, can be generally divided into two driving modes, industry regulation (IR), and administrative supervision (AS). The authors firstly establish payoff functions based on traditional income function and marginal effort-cost function. And then they analyze strategic equilibriums of the supervisors and the manufacturers based on their decision roles in the two modes. After that, they make comparisons on equilibrium states between IR and AS. From the results, they find that strategic equilibriums in AS construction is not necessarily better than those in IR construction. These results can also provide strategic help for CS construction in supply chain management when considering better combination between IR and AS.

Leading international best regulatory principles in responsible lending policy: lessons for Namibia

The economic downturn following the 2008 global financial crisis has inter alia invoked a movement towards responsible lending practices in order to protect credit consumers from irresponsible lending and over-indebtedness. In Namibian consumer credit law, inasmuch as debt prevention measures are contained in three pieces of legislation, there are still no responsible lending measures in place. This article provides an overview of the current and emerging international regulatory measures intended to promote responsible lending policy. It begins by tracing the development of consumer credit policies from truth-in-lending to responsible lending responses. It then provides a broad survey of the efforts aimed at promoting responsible lending policy with the aim of determining current trends and guidelines for devising a responsible lending regime and formulates leading international best principles for a modern and effective responsible lending regime. It is submitted that these leading international best principles can be useful lessons for countries such as Namibia and other developing countries alike in improving their national consumer credit law policies.

This paper discusses the role and operations of consumer Credit Bureaus in the European Union in the context of the economic theories, policies and law within which they work. Across Europe there is no common practice of sharing the credit data of consumers which can be used for several purposes. Mostly, they are used by the lending industry as a practice of creditworthiness assessment or as a riskmanagement tool to underwrite borrowing decisions or price risk. However, the type, breath, and depth of information differ greatly from country to country. In some Member States, consumer data are part of a broader information centralisation system for the prudential supervision of banks and the financial system as a whole. Despite EU rules on credit to consumers for the creation of the internal market, the underlying consumer data infrastructure remains fragmented at national level, failing to achieve univocal, common, or defined policy objectives under a harmonised legal framework. Likewise, the establishment of the Banking Union and the prudential supervision of the Euro area demand standardisation and convergence of the data used to measure debt levels, arrears, and delinquencies. The many functions and usages of credit data suggest that the policy goals to be achieved should inform the legal and institutional framework of Credit Bureaus, as well as the design and use of the databases. This is also because fundamental rights and consumer protection concerns arise from the sharing of credit data and their expanding use.
