In recent years, debates on same-sex marriage and the recognition of transwomen as women have been raging. These debates often seem to revolve around the meaning of, respectively, the word "marriage" and "woman". That such debates should take place might be puzzling. It seems that if debates on gay and transgender rights revolve around the meaning of these words, then those in favor of same-sex marriage and of the recognition of transwomen as women have no room left to maneuver. However, prima facie, the pro-and anti-, in both cases, have genuine disagreements over the meaning of these words: though the analyses of revisionary theorists are revisionary, they are analyses. Sally Haslanger and other philosophers in her wake have appealed to an anti-descriptivist externalist view of meaning to provide the conceptual foundations of this practice of revisionary theorizing: revisionary analyses bring to light what, unbeknownst to us, these words mean. In this paper, I argue that a descriptivist externalist view should be preferred instead. My argument rests on the thesis that what is contested in these debates is the (descriptive) meaning of the words 'marriage' and 'women' as used in the law.

THE CONCEPT OF FUNCTION OF LAW IN MODERN LEGAL THEORYSummary: The paper deals with defining and using the concept of function of law in modern legal theory. The crux of the matter is the number of significant shortcomings in understanding and using the law as a legal means to address social problems, the excessive legislative redundancy and the lack of adequate analysis and understanding of the function of law as one of the main types of legal instruments. In legal theory, the concept of function of law is not developed. To a large extent, the purpose of the law and the determination of its properties are explained by the category of standard and its derived static characteristics. The regulatory characteristic of the law should be supplemented by the identification of its functional properties reflecting the systematic and controlled process of making the legal opportunity into reality. Keywords: law, legal instrument, lawmaking, function of law, standard, legal opportunity, reality.Важным направлением совершенствования эффективности законодательной деятельно-сти современного государства является разработка проблем инструментального понимания роли и назначения законодательных актов, их реализации и действия. Анализ практики парла-ментов многих стран мира (Россия, Франция, Германия, США и др.) показывает, что количество принимаемых законодательных актов постоянно множится. Зачастую они становятся лишь обы-денным результатом стандартной практики парламентской деятельности. При этом в тех слу-чаях, когда тот или иной законодательный акт оказывается неэффективным, не работает, а также не содержит четких и обоснованных целей, механизмов реализации, конкретных ожидаемых ре-зультатов, он не связывается с какой бы то ни было формой и мерой политической, не говоря уже правовой, ответственности.Известный правовед Ю.А. Тихомиров, анализируя проблемы действия закона как элемента эффективного управления на основе права, справедливо пишет: «Реальность права -в его дей-ствии, реализации, развитии, защите и обновлении. Пока же здесь сделано мало, ибо пафос правотворчества затмил весь правовой горизонт» [1]. В связи с этим вполне обосновано требо-вание о «формировании и введении всеобъемлющего мониторинга права» [2].Критикуя позитивистскую концепцию права, французский правовед А. Гарапон подчерки-вает, что в «сугубо "законоцентричной" концепции права пробита брешь, а в роли тарана высту-пили два разных по природе, но взаимодействующих друг с другом явления: это, с одной сто-роны, обесценивание текстов законов, мало подходящих к изменчивому содержанию реальной жизни, и интеграция государств в наднациональное политическое сообщество, с другой» [3].С одной стороны, актуальной задачей в сфере правотворчества является обеспечение от-ветственного, эффективного законодательствования, лишенного излишнего пафоса от самого процесса издания новых законодательных актов, а также стремления к количественному увели-чению законодательного массива.
