ПРИНЦИП RES JUDICATA ЯК СКЛАДОВА ПРИНЦИПУ ЮРИДИЧНОЇ ВИЗНАЧЕНОСТІ В ЦИВІЛЬНОМУ СУДОЧИНСТВІАнотація. У статті досліджено проблемне питання співвідношення принципів res judicata та юридичної визначеності. У результаті аналізу принципу юридичної визначеності виокремлені такі елементи останнього, як: 1) ясність законодавства; 2) концепція легітимних очікувань; 4) відсутність зворотної дії закону; 5) принципи nullum crimen sine lege та nullum poena sine lege; 6) принцип res judicata.Водночас складовими принципу res judicata є: 1) наявність істотних підстав для перегляду судового рішення, що набрало законної сили; 2) наявність обмеженого кола підстав для перегляду судових рішень за ініціативою посадових осіб держави, які не були учасниками справи в суді першої інстанції; 3) необхідність дотримання порядку оскарження судових рішень; 4) заборона безпідставного поновлення строків апеляційного та касаційного оскарження;заборона оскарження судових рішень з метою нового розгляду справи (замасковане оскарження); 5) заборона подачі та розгляду тотожних позовів; 6) дотримання правил преюдиції.Досліджено практику Верховного Суду, виокремлено три підходи визначення сутності принципу res judicata: а) принцип res judicata -елемент права на справедливий судовий розгляд; б) принцип res judicata -елемент принципу юридичної визначеності; в) принцип res judicata тотожний принципу юридичної визначеності. Наведені відповідні рішення Верховного Суду для ілюстрації зазначених підходів.На підставі аналізу доктринальних джерел, практики Європейського суду з прав людини та практики Верховного Суду доводиться, що принцип res judicata у цивільному судочинстві слід розглядати як складову юридичної визначеності у контексті гарантій права на справедливий судовий розгляд, закріпленого у п. 1 ст. 6 ЄКПЛ.
