Individuals within the same jurisdiction often have different perceptions of the legal system, a phenomenon we call legal disagreement. Cross-country analyses of legal institutions generally ignore this kind of within-country variation. This article defines the concept of legal disagreement, identifies its potential causes and consequences, and shows that it can be measured using data from cross-country surveys. We argue that legal disagreement is likely to be caused by differences in individuals’ sources of information about the legal system, how the system treats cases of a given type, or how individuals process legal information, all of which may be related to differences in social position. We also suggest that understanding why individuals disagree about legal systems is valuable for several reasons, particularly when the disagreement reflects systematic differences in beliefs across people in different social positions. We use data from World Justice Project population surveys to create quantitative measures of legal disagreement for 128 countries or jurisdictions. We identify correlations between legal disagreement and measures of its potential causes and consequences, such as perceptions of discrimination and ethnic fractionalization. We also provide evidence that those variations are driven by differences in perceptions that track differences in gender, financial well-being, and class.

The aim of the research is to analyses and, using analogy, to examine exhaustively the areas of legal uncertainty in the mechanism of social capital formation of commercial entities, while at the same time checking the coherence of the statutory analogy and the analogy in law as a universal means of protecting and combating gaps in the business sphere. A combination of general logical methods of analysis and synthesis, induction and deduction, comparison and generalization, characteristic of works dealing with civil law, were applied. At the same time, the analogy method was used as a research tool and as a research tool. The conclusions of the work include the identification of specific gaps in the legal regulation of the procedure, methods, and terms of payment of share capital, the identification of ways to overcome these gaps casually and the formulation of proposals for the legislative updating of the regulatory structure of the share capital of commercial companies.

El objetivo de esta investigación fue mostrar cuán activamente se aplica el mecanismo de analogía legal en la práctica actual del derecho civil, identificando las razones del papel principal de la analogía legal como herramienta activa en el proceso de administración de justicia. El método de analogía fue considerado como la herramienta clave del objeto del estudio, y junto con los instrumentos jurídicos y técnicos comparativos especiales, el autor aplicó métodos lógicos generales que son característicos de los estudios más civilizados, como el análisis y síntesis, inducción y deducción, comparación y generalización. Además, el autor definió algunos casos importantes que se decidieron mediante la aplicación de analogías legales y pueden constituir la base para futuras investigaciones en el desarrollo de la práctica judicial pertinente. En este sentido, el aporte del autor consiste en un nuevo concepto de la correlación entre el desarrollo y el desglose de los estándares legales y el grado de demanda de analogía legal en la jurisprudencia.
