Inclusive institutions play an important role in development. But how do inclusive institutions emerge? Inclusion is always the product of a tradeoff. The existing literature focuses on the tradeoffs that yield an extension of the franchise, which requires costly power-sharing agreements. This article uses evidence from ancient Athens to show that meaningful forms of welfare-enhancing inclusion need not await the historically infrequent and high-stakes conditions that compel dominant elites to share power. In the 4th century BCE, the Athenians extended access to economic, social, and legal institutions to selected categories of non-citizens. They did not, however, extend the franchise. The Athenian tradeoff between political and other forms of inclusion was a response to the conflicting demands of social order and growth. While falling short of full political inclusion, the tradeoff was nonetheless conducive to political and economic development.

Что такое сила закона? Если на вас напали и вы зовете на по-мощь, явится ли закон, чтобы вас спасти? Нет, ведь это всего лишь письменный текст, который не может прийти к вам на помощь. В чем же тогда состоит его сила? Его сила -это вы [присяжные], если вы охраняете закон и применяете его всякий раз, когда кто-Цель: выявление особенностей сущности, содержания и функционирования правового порядка в древних Афинах. Методы: методологическую основу исследования составляет всеобщий диалектический метод познания, позво-ляющий изучать явления и процессы окружающей действительности в их историческом развитии, во взаимосвязи и взаимообусловленности, и основанные на нем общенаучные, специальные и частноправовые методы исследования. Результаты: демократические Афины отличались стабильностью и процветанием, однако этот город-государство никогда не имел централизованной власти правовых институтов. Основываясь на интерпретации правопорядка по принципу «что есть закон», разработанному Hadfield и Weingast, в работе обосновано, что правовой порядок в Афи-нах опирался на институты, обеспечивающие единое понимание правовых норм и единую систему поощрений для правоприменителей в условиях значительно децентрализованной системы принуждения.* Впервые статья на английском языке опубликована издательством Oxford University Press от имени The John M. Does the Republic depict a conspiracy? The ostensible impetus for discussing profound political change behind closed doors is a desire to discuss the meaning of justice, not to replace a political order with a new one. But the dialogue takes place during the Peloponnesian War, when fears of plots sporadically consumed an eroding Athenian democracy. Arguments about political instability and instances of plotting reverberate throughout dialogue that takes shape in this suspicious climate. Whether Socrates makes us privy to a conversation about a political world that does not exist or presents us with a strategy for talking about revolution undetected remains unresolved. I argue that Athenian fears of secret power and revolution express themselves in the style and arguments of the Republic and suggest that already at the origins of democratic practice, critics like Plato were concerned with theorizing the subtleties of democratic erosion.
