The environmental justice (EJ) literature can benefit from comparative analysis that helps to identify conditions for more and less successful outcomes. A data set of 50 EJ cases in the U.S. was developed with high and low remediation as the outcome. Causal conditions were selected on theoretical grounds, and included five mobilizing strategies (local and state government coalitions, federal government attention, civil disobedience, litigation, and national NGO support) and three general conditions (absence of industry countermobilization, presence of water pollution, and proposed or new siting). Qualitative comparative analysis and other analyses indicated that all causal conditions were found in the high-remediation cases but that some conditions (water pollution and local-state coalitions) were more consistently associated with the high-remediation outcome. The analysis points to the value of systematic studies of the factors that affect local EJ outcomes and to the need for better case study collections.

Damage estimation in mass torts involving hazardous or defective products is often complicated by the unknown time-profile of disease incidence or failure rate. Because these cases involve diseases with long latencies or involve products that fail after years of productive use, estimation of the defendants' future liability stream requires a model that can predict how the failure rate or the onset of the disease will change over time.This paper proposes such a model. The estimation technique allows one to compute the 'excess risk' attributable to the hazard or product defect distinct from the natural causes of failure or disease incidence and to calculate the defendants' future liability stream based on the estimates of failure or incidence rates. An environmental health scientist and mediator was appointed for the first time as a special master to oversee cleanup of a hazardous waste site in California. The case analysis examines the creative assimilation of Integralive/mutual gains bargaining (mediation) into a distributive/zero-sum bargaining construct (litigation). The special master played multiple, overlapping, and conflicting roles as the case unfolded. The interfaces and tensions of these roles produced a hybrid style of dispute resolution, termed "mediation-negotiation" by the author.
