In diesem Kapitel sollen mögliche Funktionen des Generalanwalts und ihre aktuelle Bedeutung kritisch untersucht werden. Zunächst sind jedoch die übergeordneten Pflichten, die der Generalanwalt bei jeglicher Ausübung seiner Befugnisse beachten muss, zu ermitteln.
A. Pflichten bei der AmtsausübungFür die Stellung der Schlussanträge trägt Art. 252 Abs. 2 AEUV dem Generalanwalt die Maxime der Unparteilichkeit und Unabhängigkeit auf, wenngleich der Generalanwalt diesen Prinzipien auch in seiner übrigen Amtstätigkeit folgen muss. Die Unparteilichkeit hat ihren Niederschlag ferner im Amtseid der Generalanwälte nach Art. 2 EuGH-Satzung und Art. 4 EuGH-VerfO gefunden. Die Einhaltung beider Maxime soll durch diverse Vorschriften zur richterähnlichen Stellung der Generalanwälte gewährleistet werden. 770 All diesen Regelungen liegt zugrunde, dass die Unabhängigkeit und Unparteilichkeit nicht nur tatsächlich bestehen muss, sondern auch im Bild der Öffentlichkeit gewährleistet sein muss. 771
