Stopping (or slowing) the revolving door: Factors related to NGRI acquittees' maintenance of a conditional release.

Abstract: The current study sought to extend the knowledge about factors associated with NGRI acquittees’ maintenance of a conditional release after hospital discharge. The medical and forensic records of 125 NGRI acquittees were reviewed to collect a variety of demographic, clinical, criminal, and aftercare factors. A hierarchical survival analysis approach to determining success was compared to data analysis strategies typically employed in the area. Survival analysis, which accounts for both conditional release succe… Show more

“…Having a substance use disorder has been shown to place an individual at risk for conditional release failure (Callahan & Silver, 1998; Monson et al ., 2001; Vitacco et al ., 2008). Data indicate that substance abuse and co-occurring disorders are highly prevalent among mentally disordered offenders (Hoff et al ., 1999; SAMHSA, 2004).…”

“…For convenience and ease of discussion, the variables were classified based on the type of variable under consideration (i.e., demographic, clinical/diagnostic, legal, and program), consistent with previous studies of conditional release (Callahan & Silver, 1998; Monson et al ., 2001; Vitacco et al ., 2008, 2011, 2013). …”

“…Prior research examining the success of release decisions indicates that significant differences have been found for the following variables: Length of stay in forensic setting, race, and type of crime (Monson, Gunnin, & Fogel, 2001). Therefore, separate analyses were conducted to determine whether there were differences in recommendation decisions based on any of these variables.…”

“…Although the public perceives the role of forensic hospitals to maintain public safety by removing "dangerous" disordered offenders from the street 2 (Steadman, 1981), programs for NGRI patients have a higher purpose. Primarily, forensic hospitals exist to provide intensive treatment to reduce symptoms of mental illness and dangerousness (Monson, Gunnin, Fogel, & Kyle, 2001), while preparing patients for potential community return (Luettgen, Chrapko, & Reddon, 1998). Nonetheless, pitfalls abound in the treatment of NGRI patients.…”
