“…5 Conversely, law categories intended to protect firearm access or use (i.e., stand your ground, immunity and preemption), were coded as present if there was no such law in place for any year in the preceding 7 years. 11,17,18,[22][23][24] In this manner, the presumed direction of association between FH and presence of a law category was consistent across all law categories. The constitution reads -A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.‖.…”

“…[1][2][3][4][5] Preemption is especially concerning when health disparities are caused by inequities that are not obvious or present on a state-wide level or when states do not enact laws to address the topics preempted. 2,3 Although preemption provisions are sometimes straightforward, state legislators have used specific tactics to obscure preemption. 6 For example, a Kansas bill preempting a wide range of food and nutrition policies used unclear language making it difficult for legislators and advocacy organizations to discern exactly what was preempted.…”

“…State preemption occurs when the state legislature withdraws or limits the authority of local governments to act on a specific topic 1. Such preemption creates challenges for communities seeking to protect and promote public health through evidence-based or innovative policy strategies 1–5. Preemption is especially concerning when health disparities are caused by inequities that are not obvious or present on a state-wide level or when states do not enact laws to address the topics preempted 2,3…”
