Early marriage in Bawean Island involved long-term experiences and understanding of actors’ sociocultural. The phenomenon of early marriage has never been studied using social construction. This research aims to reveal the social construction of early marriage through the dialectical situation of externalization, objectivation, and internalization in early marriage. This research uses a qualitative case study approach by collecting data through participant observation, in-depth interviews, and documentation. This research was conducted on Bawean Island with 31 participants throughout 2023. The results of this study were as follows: first, actors perceived and interpreted early marriage as avoiding social sanctions (out-of-wedlock pregnancy) to avoid social embarrassment; economic solutions; religion does not prohibit early marriage; avoiding religious sanctions; and early marriage is not considered to violate state law and can be legalized. Second, early marriage continued because parents and other social organizations, such as religious leaders and hamlet heads, acquired social capital. The role of hamlet heads in supporting the administration and testifying in the marriage dispensation trial is regarded as objective, allowing the state to legalize early marriages. In addition to continuing practical programs aimed at female actors, outreach to the entire family about the dangers of early marriage, and adding psychological and health expert witnesses to trials, special consideration must be given to social capital, which needs to be taken into account in future research.

Hence, Islamic law recommends marriage between a man and a woman, aiming towards continuing offspring and increasing the number of people of the Prophet Muhammad PBUH as stated in the hadiths.…”

Childfree is a life choice not to have children after or before marriage, whether biological children, stepchildren, or adopted children. This article discusses how childfree is influenced by the digital era and what the perspective of Islamic law is according to the views of ulama and gender activists in Malang, East Java. This empirical legal study used legal sociology and maqāṣid al-sharī’ah approaches. Data were collected by means of in-depth interviews and a literature review. Findings showed that child-free development in Indonesia has been influenced by the digital era through online media, which quickly spread and made it easier for people from various countries to interact and share information. One of the objectives of Islamic law (maqāṣid al-sharī'ah) is to maintain offspring (hifz al-nasl) through marriage. According to the ulama, being childfree is contrary to Islamic law and the nature of humanity. According to the Nahdlatul Ulama, Muhammadiyah, and gender activists, the laws on childfree can be summed up in two ways: haram and mubah. Childfree is haram (unlawful) because it is contrary to maqāṣid al-sharī’ah, i.e., preserving offspring, as it is also the goal of marriage. Childfree is mubah (allowed) if there are reasons that are condoned by the sharia, e.g., health problems, physical limitations, and psychological conditions that prevent the wife from having children. Sociologically, the government and all related parties need to provide education to the public so that the meaning of childfree can be understood properly and correctly.

Penelitian ini bertujuan untuk menganalisis bagaimana Dinamika pertumbuhan keluarga sakinah di kecamatan sukorejo yang diukur dari aspek sakinah yang terbagi menjadi Pra Sakinah, Sakinah 1 dan seterusnya menggunakan data dan pengukuran dari jumlah perceraian dan pernikahan. Penelitian ini menggunakan metode penelitian kualitatif yang bersifat non interaktif. Dengan mengumpulkan data dari sumber primer maupun sekunder dalam bentuk kitab/buku atau hasil riset terdulu yang berhubungan dengan dinamika keluarga sakinah. Penelitin ini menghasilkan temuan bahwa masyarakat Kecamatan Sukorejo termasuk kategori keluarga Sakinah 1, dan telah melewati fase pra sakinah. Hal ini dibuktikan dengan angka pernikahan di Kecamatan Sukorejo dari tahun ke tahun mengalami kenaikan dan dalam jumlah yang cukup banyak. Angka pernikahan menyentuh angka 300 an setiap tahunnya dibandingkan dengan perceraian yang hanya diangka 60-an setiap tahunnya.
