Reflexões sobre a proteção penal do patrimônio histórico e cultural brasileiro

Abstract: O Brasil protege seu patrimônio histórico e cultural de forma ampla, a partir do contido no artigo 216 da Constituição. Esta proteção dá- no âmbito administrativo, através do tombamento de bens de reconhecido valor histórico ou arquitetônico e de outras medidas. Na esfera civil, via responsabilização do infrator impondo-lhe o dever de indenizar a coletividade por danos que eventualmente cause.
