Reflexões sobre a proteção penal do patrimônio histórico e cultural brasileiro

Abstract

O Brasil protege seu patrimônio histórico e cultural de forma ampla, a partir do contido no artigo 216 da Constituição. Esta proteção dá- no âmbito administrativo, através do tombamento de bens de reconhecido valor histórico ou arquitetônico e de outras medidas. Na esfera civil, via responsabilização do infrator impondo-lhe o dever de indenizar a coletividade por danos que eventualmente cause. E penal, sendo esta última forma de proteção, cuja base está nos artigos 62 a 65 da Lei 9.605, de 12 de fevereiro de 1998, o complemento das demais. Neste artigo busca-se demonstrar a importância das normas penais na proteção do patrimônio histórico e cultural e a efetividade de sua aplicação.

In Civil Construction, these pathologies can be consequences of inadequate execution, design errors, low quality material, lack or scarcity of building maintenance, these problems that can be generated by the negligence of the person responsible for conducting the work or manager (Freitas & Freitas, 2015). For Olivari (2003), pathological manifestations are characterized as the unhealthy fragment of a building, which is made possible through the failures that occurred in the construction of the building, as well as throughout its useful life.…”
