Este libro analiza la conexión entre el cambio climático y los derechos humanos, específicamente el impacto del fenómeno peligroso en el individuo, grupos y componentes de la naturaleza. Se presenta un estudio detallado de aproximaciones judiciales basadas en la protección de derechos fundamentales desde la perspectiva litigiosa de casos del Norte y Sur Global. La obra busca promover el litigio estratégico ante los mecanismos de protección de derechos humanos, concretamente, el sistema interamericano. A lo largo de cuatro capítulos se identifican obligaciones climáticas en la Convención Americana sobre Derechos Humanos, particularmente, aquellas asociadas con el cumplimiento de los deberes de respeto y garantía de los derechos a la propiedad colectiva, medio ambiente sano, acceso a la información, participación y consulta en los asuntos ambientales, así como el derecho al acceso a la justicia y el debido proceso. El libro identifica un marco jurídicamente vinculante para atribuir la responsabilidad del Estado frente a la violación de los derechos humanos en un contexto de cambio climático peligroso. Asimismo, propone una hoja de ruta que permita modular el riesgo de daño dentro de la exigibilidad y aplicabilidad que brinda la Convención Americana.

Damming and Infrastructural Development of the Indus River Basin: Strengthening the Provisions of the Indus Waters Treaty

Whilst the Indus Waters Treaty of 1960 allows for damning and infrastructural development in the Indus River Basin, it does so without factoring in environmental considerations. This is because environmental standards in international law, except those related to pollution control, were largely absent when the Treaty was negotiated in the 1950s. Given the increasing list of development-related disputes between India and Pakistan, and their aspirations for further damming and other infrastructural works in the Basin, this paper seeks to close the gaps in the Treaty’s provisions and developments in international environmental law to date. To do so effectively, the paper analyzes the relevant provisions of the UN Watercourses Convention, supplemented with an examination of the European regional framework. Based on these, it proposes changes to the Treaty so that both India and Pakistan are able to work within a legal framework which not only provides for environmental impact assessments for planned projects, but enhances monitoring, assessments, and reporting. This will ensure that such developments are not only environmentally sound but also help to alleviate some of the disputes between India and Pakistan.

Informed consent is at the center of the Rotterdam Convention on Prior Informed Consent and the Cartagena Protocol on Biosafety. Consistent with the idea of a negotiation "formula," it encapsulates the principles underlying parties' demands by balancing the efficiency of unconstrained trade with ethically charged support for autonomy and selfdetermination. As a negotiated rule, informed consent translates the formula into specific procedural requirements based on risk assessment. Parties' fundamental interest to enhance food security via the two treaties is used to illustrate both the principle and rule aspects of informed consent. In addition, the value of formula analysis in negotiation theory is investigated. The article supports increased attention to informed consent in international relations, to the merits of formula analysis, and to the possibility of better understanding a fundamental objective such as food security through a formula-guided analysis of these and related negotiated outcomes.
