Civilly committed sexually violent persons (SVPs) are a select group of individuals designated as high risk for future sexual violence. Despite risk reduction in older age, SVP programs are seeing aging client populations, with many individuals remaining committed after age 60 (60+). Recent research found a sexual recidivism rate of 7.5% for 60+ individuals released from an SVP civil commitment program. The current paper follows up by examining reasons why individuals remain committed after age 60. It compares SVPs discharged after age 60 to those who are 60+ but remain civilly committed. Results of bivariate analyses reveal older SVPs who remain committed have significantly higher actuarial risk scores and are more likely to be of minority race. Multivariate logistic regression analyses found actuarial risk scores (Static-99R) predicted continued commitment, after controlling for other relevant variables. Barriers to community reintegration and suggestions for multi-disciplinary case management for older SVPs are discussed.

We examined state-wide data of persons evaluated for Sexually Violent Predator (SVP) commitment and compared risk-relevant data of three groups: those committed as SVPs ( n = 374), those not recommended for commitment ( n = 2,707), and those nearly committed (recommended for commitment but ultimately not committed; n = 117). Consistent with legal language for SVP commitment, binary and multinomial regression analyses revealed risk scores predicted SVP commitment recommendations in addition to some historical factors (e.g., psychiatric history, never being married, prior sex offenses). For those recommended for commitment, prior sexual offenses predicted ultimate commitment. Those nearly committed had significantly higher sexual recidivism rates than others who were not committed; however, these recidivism rates were still low (11.5%). Findings suggest evaluators’ SVP decisions incorporate risk data and follow empirically supported trends; however, the observed recidivism rates of a subset of those SVP commitment appears to target suggests SVP commitment’s potential for reducing sexual recidivism effectively and efficiently appears to have a low ceiling.

RESUMOO objetivo do presente estudo foi avaliar diferenças no perfil criminal de autores de violência sexual contra crianças e adolescentes (AVS) considerados psicopatas e não psicopatas. Participaram 30 reeducandos cumprindo pena em regime fechado, que foram divididos em dois grupos: G1, composto pelos AVS considerados psicopatas (PCL-R≥30); e G2, composto pelos AVS considerados não psicopatas (PCL-R<30). Para a coleta de dados, foi utilizado o Psychopathy Checklist -Revised (PCL-R), e as análises foram feitas por meio de estatísticas descritiva e comparativa. Os resultados apontaram diferenças significativas entre os grupos com relação ao tempo de pena, à quantidade de fuga e rebelião, assim como o número de processos e de vítimas, mostrando que os AVS psicopatas são mais indisciplinados e têm mais chances de reincidir criminalmente do que os não psicopatas, e que, comumente, costumam vitimizar mais pessoas e cometer uma maior variedade de crimes do que os não psicopatas.Palavras-chave: personalidade antissocial; violência sexual; psicologia criminal. ABSTRACT -Psychopathy and Sex Offences against Children and AdolescentsThe aim of the present study was to evaluate differences in the profiles of sex offenders considered psychopaths and nonpsychopaths that committed crimes against children and adolescents. The subjects of this study were 30 re-educated criminals serving a prison sentence, organized into two groups: G1, consisting of sex offenders considered psychopaths (PCL-R≥30); and G2, consisting of non-psychopaths (PCL-R<30). The Psychopathy Checklist-Revised (PCL-R) was used to collect data, and the analyses were performed using descriptive and comparative statistics. The results presented significant differences between the two groups in terms of the amount of time spent in incarceration, the quantity of prison breaks and rebellions, and the number of cases and victims. This shows that psychopathic sex offenders are more undisciplined and more recidivists than non-psychopaths, and that they often victimize more people and commit a greater variety of crimes than non-psychopaths.
